| 8 | 8 | | National Aeronautics and Space Administration security personnel. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2.122, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended by adding Subsection (h) to read as follows: |
|---|
| 12 | 12 | | (h) National Aeronautics and Space Administration security |
|---|
| 13 | 13 | | personnel, including contractor security personnel who have |
|---|
| 14 | 14 | | completed the training required by the administration to serve in |
|---|
| 15 | 15 | | that capacity, are not peace officers under the laws of this state, |
|---|
| 16 | 16 | | but have the powers of arrest, search, and seizure, including the |
|---|
| 17 | 17 | | powers under Section 9.51, Penal Code, while in the performance of |
|---|
| 18 | 18 | | the personnel's duties: |
|---|
| 19 | 19 | | (1) on property owned, leased, or controlled by the |
|---|
| 20 | 20 | | administration; or |
|---|
| 21 | 21 | | (2) under an agreement entered into with local law |
|---|
| 22 | 22 | | enforcement regarding an area surrounding property owned, leased, |
|---|
| 23 | 23 | | or controlled by the administration. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
