66 AN ACT
77 relating to the authority of a state agency to contest the issuance
88 of a permit or license by the Texas Commission on Environmental
99 Quality.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 5.115(b), Water Code, is amended to read
1212 as follows:
1313 (b) At the time an application for a permit or license under
1414 this code is filed with the executive director and is
1515 administratively complete, the commission shall give notice of the
1616 application to any person who may be affected by the granting of the
1717 permit or license. [A state agency that receives notice under this
1818 subsection may submit comments to the commission in response to the
1919 notice but may not contest the issuance of a permit or license by
2020 the commission. For the purposes of this subsection, "state
2121 agency" does not include a river authority.]
2222 SECTION 2. The change in law made by this Act applies only
2323 to an application for the issuance, amendment, extension, or
2424 renewal of a permit or license that is received by the Texas
2525 Commission on Environmental Quality on or after the effective date
2626 of this Act. An application that is received before that date is
2727 governed by the law in effect at the time the application is
2828 received, and the former law is continued in effect for that
2929 purpose.
3030 SECTION 3. This Act takes effect September 1, 2023.
