| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 5.115(b), Water Code, is amended to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | (b) At the time an application for a permit or license under |
|---|
| 14 | 14 | | this code is filed with the executive director and is |
|---|
| 15 | 15 | | administratively complete, the commission shall give notice of the |
|---|
| 16 | 16 | | application to any person who may be affected by the granting of the |
|---|
| 17 | 17 | | permit or license. [A state agency that receives notice under this |
|---|
| 18 | 18 | | subsection may submit comments to the commission in response to the |
|---|
| 19 | 19 | | notice but may not contest the issuance of a permit or license by |
|---|
| 20 | 20 | | the commission. For the purposes of this subsection, "state |
|---|
| 21 | 21 | | agency" does not include a river authority.] |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an application for the issuance, amendment, extension, or |
|---|
| 24 | 24 | | renewal of a permit or license that is received by the Texas |
|---|
| 25 | 25 | | Commission on Environmental Quality on or after the effective date |
|---|
| 26 | 26 | | of this Act. An application that is received before that date is |
|---|
| 27 | 27 | | governed by the law in effect at the time the application is |
|---|
| 28 | 28 | | received, and the former law is continued in effect for that |
|---|
| 29 | 29 | | purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
