44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to public school accountability, including assessment of
77 academic skills, performance standards and sanctions, and public
88 high school graduation requirements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.053, Education Code, is amended by
1111 amending subsection (c) to read as follows:
1212 (c) School districts and campuses must be evaluated based on
1313 three domains of indicators of achievement adopted under this
1414 section that include:
1515 (1) in the student achievement domain, indicators of
1616 student achievement that must include:
1717 (A) for evaluating the performance of districts
1818 and campuses generally:
1919 (i) an indicator that accounts for the
2020 results of assessment instruments required under Sections
2121 39.023(a), (c), and (l), as applicable for the district and campus,
2222 including the results of assessment instruments required for
2323 graduation retaken by a student, aggregated across grade levels by
2424 subject area, including:
2525 (a) for the performance standard determined by the
2626 commissioner under Section 39.0241(a), the percentage of students
2727 who performed satisfactorily on the assessment instruments,
2828 aggregated across grade levels by subject area; and
2929 (b) for the college readiness performance standard as
3030 determined under Section 39.0241, the percentage of students who
3131 performed satisfactorily on the assessment instruments, aggregated
3232 across grade levels by subject area; and
3333 (ii) an indicator that accounts for the
3434 results of assessment instruments required under Section
3535 39.023(b), as applicable for the district and campus, including the
3636 percentage of students who performed satisfactorily on the
3737 assessment instruments, as determined by the performance standard
3838 adopted by the agency, aggregated across grade levels by subject
3939 area; and
4040 (iii) an indicator that accounts for the
4141 number of students who participate in and successfully complete
4242 courses in the enrichment curriculum under Section 28.002(a)(2);
4343 and
4444 (A-1) for evaluating the performance of
4545 elementary and middle school campuses, indicators that account for:
4646 (i) students in grades six, seven, and
4747 eight who successfully complete and receive credit for a course
4848 designated for a grade higher than the grade in which the student is
4949 enrolled; and
5050 (ii) students in grades six, seven, and
5151 eight, who successfully complete a career and technology course
5252 under Section 48.106; and
5353 (B) for evaluating the performance of high school
5454 campuses and districts that include high school campuses,
5555 indicators that account for:
5656 (i) students who satisfy the Texas Success
5757 Initiative (TSI) college readiness benchmarks prescribed by the
5858 Texas Higher Education Coordinating Board under Section 51.334 on
5959 an assessment instrument in reading or mathematics designated by
6060 the coordinating board under that section;
6161 (ii) students who satisfy relevant
6262 performance standards on advanced placement tests or similar
6363 assessments;
6464 (iii) students who earn dual course credits
6565 in the dual credit courses;
6666 (iv) students who enlist in the armed
6767 forces of the United States or the Texas National Guard;
6868 (v) students who earn industry
6969 certifications;
7070 (vi) students admitted into postsecondary
7171 industry certification programs that require as a prerequisite for
7272 entrance successful performance at the secondary level;
7373 (vii) students whose successful completion
7474 of a course or courses under Section 28.014 indicates the student's
7575 preparation to enroll and succeed, without remediation, in an
7676 entry-level general education course for a baccalaureate degree or
7777 associate degree;
7878 (viii) students who successfully met
7979 standards on a composite of indicators that through research
8080 indicates the student's preparation to enroll and succeed, without
8181 remediation, in an entry-level general education course for a
8282 baccalaureate degree or associate degree;
8383 (ix) high school graduation rates, computed
8484 in accordance with standards and definitions adopted in compliance
8585 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
8686 subject to the exclusions provided by Subsections (g), (g-1),
8787 (g-2), (g-3), and (g-4);
8888 (x) students who successfully completed an
8989 OnRamps dual enrollment course;
9090 (xi) students who successfully completed a
9191 practicum or internship approved by the State Board of Education;
9292 (xii) students who are awarded an associate
9393 degree; [and]
9494 (xiii) students who successfully completed
9595 a program of study in career and technical education; and
9696 (xiv) students who successfully complete at
9797 least one endorsement under Section 28.025(c-1); and
9898 (xv) students who earn micro-credentials or
9999 credentials of value as defined by the State Board of Education; and
100100 (2) in the school progress domain, indicators for
101101 effectiveness in promoting student learning, which must include:
102102 (A) for assessment instruments, including
103103 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
104104 percentage of students who met the standard for improvement, as
105105 determined by the commissioner; and
106106 (B) for evaluating relative performance, the
107107 performance of districts and campuses compared to similar districts
108108 or campuses; and
109109 (3) in the closing the gaps domain: [,]
110110 (A) the use of disaggregated data to demonstrate
111111 the differentials among students from different racial and ethnic
112112 groups, socioeconomic backgrounds, and other factors, including:
113113 (i) [(A)] students formerly receiving special education
114114 services;
115115 (ii) [(B)] students continuously
116116 enrolled; and
117117 (iii) [(C)] students who are mobile;
118118 and [.]
119119 (B) in evaluating the performance of elementary
120120 and middle school campuses, the commissioner shall use indicators
121121 as defined in Subsection (c)(1)(A)(iii)-(vi) and (A-1), for the
122122 School Quality component.
123123 SECTION 2. This act applies beginning with the 2023-2024
124124 school year.
125125 SECTION 3. This Act takes effect immediately if it receives
126126 a vote of two-thirds of all the members elected to each house, as
127127 provided by Section 39, Article III, Texas Constitution. If this
128128 Act does not receive the vote necessary for immediate effect, this
129129 Act takes effect September 1, 2023.
