55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the financial crimes intelligence center.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2312.001, Occupations Code, is amended
1010 by adding Subdivisions (4-a) and (4-b) and amending Subdivision (5)
1111 to read as follows:
1212 (4-a) "Motor fuel manipulation device" means a
1313 mechanism manufactured, assembled, or adapted to manipulate or
1414 alter a motor fuel metering device or a motor fuel unattended
1515 payment terminal for an unlawful purpose.
1616 (4-b) "Motor fuel theft" means an act that:
1717 (A) constitutes an offense under Section 31.03,
1818 Penal Code; and
1919 (B) qualifies for an affirmative finding of motor
2020 fuel theft under Article 42.019, Code of Criminal Procedure.
2121 (5) "Skimmer" means an electronic, mechanical, or
2222 other device that may be used to unlawfully intercept electronic
2323 communications or data to perpetrate card fraud. The term includes
2424 a credit card shimmer.
2525 SECTION 2. Section 2312.052, Occupations Code, is amended
2626 to read as follows:
2727 Sec. 2312.052. PURPOSES OF CENTER. The purposes of the
2828 center are to:
2929 (1) serve as the state's primary entity for the
3030 planning, coordination, and integration of law enforcement
3131 agencies and other governmental agencies that respond to criminal
3232 activity related to card fraud, including through the use of
3333 skimmers, and motor fuel theft; and
3434 (2) maximize the ability of the department, law
3535 enforcement agencies, and other governmental agencies to detect,
3636 prevent, and respond to criminal activities related to card fraud
3737 and motor fuel theft.
3838 SECTION 3. Section 2312.054, Occupations Code, is amended
3939 by amending Subsections (b) and (c) and adding Subsection (b-1) to
4040 read as follows:
4141 (b) The center shall assist law enforcement agencies, other
4242 governmental agencies, financial institutions, credit card
4343 issuers, debit card issuers, payment card networks, institutions of
4444 higher education, and merchants in their efforts to develop and
4545 implement strategies to:
4646 (1) detect skimmers and motor fuel manipulation
4747 devices;
4848 (2) ensure an effective response if a skimmer or motor
4949 fuel manipulation device is found; and
5050 (3) prevent card fraud and motor fuel theft.
5151 (b-1) On request of a law enforcement or other governmental
5252 agency, the center may provide assistance to that agency regarding
5353 any matter within the center's expertise.
5454 (c) The center may:
5555 (1) serve as a centralized collection point for
5656 information related to card fraud and motor fuel theft;
5757 (2) provide training and educational opportunities to
5858 law enforcement;
5959 (3) provide outreach to the public; and
6060 (4) release information to affected financial
6161 institutions, credit card issuers, debit card issuers, payment card
6262 networks, institutions of higher education, and merchants if the
6363 center does not consider the information to be sensitive to law
6464 enforcement.
6565 SECTION 4. Section 2312.055(b), Occupations Code, is
6666 amended to read as follows:
6767 (b) The report must include:
6868 (1) a plan of operation for the center and an estimate
6969 of the amount of money necessary to implement that plan;
7070 (2) an assessment of the current state of card fraud
7171 and motor fuel theft in this state, including:
7272 (A) an identification of the geographic
7373 locations in this state that have the highest statistical
7474 probability for card fraud and motor fuel theft; and
7575 (B) a summary of card fraud and motor fuel theft
7676 statistics for the year in which the report is filed;
7777 (3) a detailed plan of operation for combatting card
7878 fraud and motor fuel theft;
7979 (4) a communications plan for outreach to law
8080 enforcement agencies, financial institutions, credit card issuers,
8181 debit card issuers, payment card networks, merchants, and the
8282 public; and
8383 (5) a list of expenditures made since the most recent
8484 report was filed with the department.
8585 SECTION 5. Section 2312.102(b), Occupations Code, is
8686 amended to read as follows:
8787 (b) A grant recipient may use grant money to:
8888 (1) reduce card fraud by removing skimmers;
8989 (2) purchase or upgrade fraud deterrence equipment,
9090 including unique locking systems, cameras, and lights;
9191 (3) provide training opportunities regarding
9292 skimmers; and
9393 (4) conduct public outreach regarding card fraud and
9494 motor fuel theft.
9595 SECTION 6. This Act takes effect September 1, 2023.
