| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 48.0051, Education Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 48.0051. INCENTIVE FOR ADDITIONAL INSTRUCTIONAL |
|---|
| 13 | 13 | | MINUTES [DAYS]. |
|---|
| 14 | 14 | | SECTION 2. Sections 48.0051(a), (b), and (c), Education |
|---|
| 15 | 15 | | Code, are amended to read as follows: |
|---|
| 16 | 16 | | (a) The [Subject to Subsection (a-1), the] commissioner |
|---|
| 17 | 17 | | shall adjust the average daily attendance of a school district or |
|---|
| 18 | 18 | | open-enrollment charter school under Section 48.005 in the manner |
|---|
| 19 | 19 | | provided by Subsection (b) if the district or school[: |
|---|
| 20 | 20 | | [(1) provides the minimum number of minutes of |
|---|
| 21 | 21 | | operational and instructional time required under Section 25.081 |
|---|
| 22 | 22 | | and commissioner rules adopted under that section over at least 180 |
|---|
| 23 | 23 | | days of instruction; and |
|---|
| 24 | 24 | | [(2)] offers, over the minimum number of minutes of |
|---|
| 25 | 25 | | operational and instructional time required under Section 25.081 |
|---|
| 26 | 26 | | and commissioner rules adopted under that section, an additional |
|---|
| 27 | 27 | | 12,600 minutes [30 days] of full-day [half-day] instruction for all |
|---|
| 28 | 28 | | students enrolled in the district or school [prekindergarten |
|---|
| 29 | 29 | | through fifth grade]. |
|---|
| 30 | 30 | | (b) For a school district or open-enrollment charter school |
|---|
| 31 | 31 | | described by Subsection (a), the commissioner shall increase the |
|---|
| 32 | 32 | | average daily attendance of the district or school under Section |
|---|
| 33 | 33 | | 48.005 by the amount that results from the quotient of the sum of |
|---|
| 34 | 34 | | attendance [by students described by Subsection (a)(2)] for each of |
|---|
| 35 | 35 | | the 12,600 [30] additional instructional minutes [days of half-day |
|---|
| 36 | 36 | | instruction] that are provided divided by 75,600 [180]. |
|---|
| 37 | 37 | | (c) The commissioner may provide the incentive under this |
|---|
| 38 | 38 | | section to a school district or open-enrollment charter school that |
|---|
| 39 | 39 | | intended, but due to circumstances beyond the district's or |
|---|
| 40 | 40 | | school's control, including the occurrence of a natural disaster |
|---|
| 41 | 41 | | affecting the district or school, was unable to meet the |
|---|
| 42 | 42 | | requirement for instruction under Section 25.081 plus an additional |
|---|
| 43 | 43 | | 12,600 minutes [30 days] of full-day [half-day] instruction. The |
|---|
| 44 | 44 | | commissioner may proportionately reduce the incentive provided to a |
|---|
| 45 | 45 | | district or school described by this subsection. |
|---|
| 46 | 46 | | SECTION 3. Section 25.085(i), Education Code, is amended to |
|---|
| 47 | 47 | | read as follows: |
|---|
| 48 | 48 | | (i) Notwithstanding any other provision of this section, a |
|---|
| 49 | 49 | | student enrolled in a school district is not required to attend |
|---|
| 50 | 50 | | school for any additional instructional minutes [days] described by |
|---|
| 51 | 51 | | Section 48.0051. |
|---|
| 52 | 52 | | SECTION 4. Section 48.0051(d), Education Code, is repealed. |
|---|
| 53 | 53 | | SECTION 5. This Act takes effect September 1, 2023. |
