55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the incentive for public schools that provide
88 additional instructional minutes for all students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 48.0051, Education Code,
1111 is amended to read as follows:
1212 Sec. 48.0051. INCENTIVE FOR ADDITIONAL INSTRUCTIONAL
1313 MINUTES [DAYS].
1414 SECTION 2. Sections 48.0051(a), (b), and (c), Education
1515 Code, are amended to read as follows:
1616 (a) The [Subject to Subsection (a-1), the] commissioner
1717 shall adjust the average daily attendance of a school district or
1818 open-enrollment charter school under Section 48.005 in the manner
1919 provided by Subsection (b) if the district or school[:
2020 [(1) provides the minimum number of minutes of
2121 operational and instructional time required under Section 25.081
2222 and commissioner rules adopted under that section over at least 180
2323 days of instruction; and
2424 [(2)] offers, over the minimum number of minutes of
2525 operational and instructional time required under Section 25.081
2626 and commissioner rules adopted under that section, an additional
2727 12,600 minutes [30 days] of full-day [half-day] instruction for all
2828 students enrolled in the district or school [prekindergarten
2929 through fifth grade].
3030 (b) For a school district or open-enrollment charter school
3131 described by Subsection (a), the commissioner shall increase the
3232 average daily attendance of the district or school under Section
3333 48.005 by the amount that results from the quotient of the sum of
3434 attendance [by students described by Subsection (a)(2)] for each of
3535 the 12,600 [30] additional instructional minutes [days of half-day
3636 instruction] that are provided divided by 75,600 [180].
3737 (c) The commissioner may provide the incentive under this
3838 section to a school district or open-enrollment charter school that
3939 intended, but due to circumstances beyond the district's or
4040 school's control, including the occurrence of a natural disaster
4141 affecting the district or school, was unable to meet the
4242 requirement for instruction under Section 25.081 plus an additional
4343 12,600 minutes [30 days] of full-day [half-day] instruction. The
4444 commissioner may proportionately reduce the incentive provided to a
4545 district or school described by this subsection.
4646 SECTION 3. Section 25.085(i), Education Code, is amended to
4747 read as follows:
4848 (i) Notwithstanding any other provision of this section, a
4949 student enrolled in a school district is not required to attend
5050 school for any additional instructional minutes [days] described by
5151 Section 48.0051.
5252 SECTION 4. Section 48.0051(d), Education Code, is repealed.
5353 SECTION 5. This Act takes effect September 1, 2023.
