55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authorization and reporting of expenditures for
88 lobbying activities by certain political subdivisions and other
99 public entities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 140, Local Government Code, is amended
1212 by adding Section 140.014 to read as follows:
1313 Sec. 140.014. EXPENDITURES FOR LOBBYING ACTIVITIES. (a)
1414 This section applies only to a:
1515 (1) political subdivision that imposes a tax;
1616 (2) political subdivision or special district that has
1717 the authority to issue bonds, including revenue bonds;
1818 (3) regional mobility authority;
1919 (4) transit authority;
2020 (5) regional tollway authority;
2121 (6) special purpose district;
2222 (7) public institution of higher education;
2323 (8) community college district;
2424 (9) publicly owned utility; and
2525 (10) river authority.
2626 (b) A political subdivision or other entity to which this
2727 section applies may spend money to directly or indirectly influence
2828 or attempt to influence the outcome of legislation pending before
2929 the legislature only if the expenditure is:
3030 (1) authorized by a majority vote of the governing
3131 body of the political subdivision or entity in an open meeting of
3232 the governing body; and
3333 (2) voted on by the governing body as a stand-alone
3434 item on the agenda at the meeting.
3535 (c) A political subdivision or other entity to which this
3636 section applies shall report to the Texas Ethics Commission and
3737 publish on the political subdivision's or entity's Internet
3838 website:
3939 (1) the amount of money authorized under Subsection
4040 (b) for the purpose of directly or indirectly influencing or
4141 attempting to influence the outcome of legislation pending before
4242 the legislature;
4343 (2) the name of each person required to register under
4444 Chapter 305, Government Code, that is retained or employed by or on
4545 behalf of the political subdivision or entity for the purpose
4646 described by Subdivision (1); and
4747 (3) an electronic copy of each contract for services
4848 for the purpose described by Subdivision (1) that is entered into by
4949 the political subdivision or entity, or by a person on behalf of the
5050 political subdivision or entity, with each person listed under
5151 Subdivision (2).
5252 (d) In addition to the requirements of Subsection (c), a
5353 political subdivision or other entity to which this section applies
5454 shall report to the Texas Ethics Commission and publish on the
5555 political subdivision's or entity's Internet website the amount of
5656 public money spent for membership fees and dues of any nonprofit
5757 state association or organization of similarly situated political
5858 subdivisions or entities that directly or indirectly influences or
5959 attempts to influence the outcome of legislation pending before the
6060 legislature.
6161 (e) The Texas Ethics Commission shall make available to the
6262 public an easily searchable database on the commission's Internet
6363 website containing the reports submitted to the commission under
6464 Subsection (c).
6565 (f) If a political subdivision or other entity to which this
6666 section applies violates this section, an interested party is
6767 entitled to appropriate injunctive relief to prevent further
6868 activity in violation of this section. For purposes of this
6969 subsection, "interested party" means a person who:
7070 (1) is a taxpayer of the political subdivision or
7171 entity; or
7272 (2) is served by or receives services from the
7373 political subdivision or entity.
7474 (g) This section does not prevent an officer or employee of
7575 a political subdivision or other entity to which this section
7676 applies from advocating for or against or otherwise influencing or
7777 attempting to influence the outcome of legislation pending before
7878 the legislature.
7979 SECTION 2. The Texas Ethics Commission is required to
8080 implement the change in law made by Section 140.014(e), Local
8181 Government Code, as added by this Act, only if the legislature
8282 appropriates money specifically for that purpose. If the
8383 legislature does not appropriate money specifically for that
8484 purpose, the Texas Ethics Commission may, but is not required to,
8585 implement that change in law using other appropriations available
8686 for the purpose.
8787 SECTION 3. This Act takes effect September 1, 2023.
