| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 127.1301(b), Election Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (b) An authority operating a central counting station under |
|---|
| 12 | 12 | | this chapter shall [may not] purchase and [or] use a centrally |
|---|
| 13 | 13 | | counted optical ballot scan system. A system under this section |
|---|
| 14 | 14 | | must use [that uses] a data storage device [disc] on which |
|---|
| 15 | 15 | | information, once written: |
|---|
| 16 | 16 | | (1) [,] is not capable of being modified; or |
|---|
| 17 | 17 | | (2) becomes unreadable if a person attempts to modify |
|---|
| 18 | 18 | | it. |

| 19 | 19 | | SECTION 2. Sections 127.1301(c), (d), and (e), Election |
|---|
| 20 | 20 | | Code, are repealed. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2023. |
