| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Chapter 2, Election Code, is |

| 11 | 11 | | amended to read as follows: |

| 13 | 13 | | SECTION 2. Chapter 2, Election Code, is amended by adding |

| 17 | 17 | | Notwithstanding any other law, an election held by a political |

| 18 | 18 | | subdivision to authorize the issuance of bonds or other debt does |

| 19 | 19 | | not authorize the issuance of bonds or other debt unless at least |
|---|
| 20 | 20 | | two-thirds of the voters voting on the proposition authorizing the |
|---|
| 21 | 21 | | issuance of bonds or other debt vote in favor of the proposition. |

| 22 | 22 | | SECTION 3. Subchapter A, Chapter 41, Election Code, is |
|---|
| 23 | 23 | | amended by adding Section 41.0051 to read as follows: |

| 24 | 24 | | Sec. 41.0051. PROPOSITION FOR APPROVAL OF ISSUANCE OF BONDS |
|---|
| 25 | 25 | | OR OTHER DEBT. (a) A proposition for approval of the issuance of |
|---|
| 26 | 26 | | bonds or other debt shall be submitted to the voters in an election |
|---|
| 27 | 27 | | held on the November uniform election date. |
|---|
| 28 | 28 | | (b) Notwithstanding Section 41.0011, a proposition |
|---|
| 29 | 29 | | described by Subsection (a) may not be submitted to the voters in an |
|---|
| 30 | 30 | | election held under that section. |
|---|
| 31 | 31 | | (c) If a law outside this code requires a proposition |
|---|
| 32 | 32 | | described by Subsection (a) to be submitted to the voters in an |
|---|
| 33 | 33 | | election held on a date other than the November uniform election |
|---|
| 34 | 34 | | date, the authority administering the election shall set the |
|---|
| 35 | 35 | | election date to comply with this section. |
|---|
| 36 | 36 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an election ordered on or after the effective date of this Act. |
|---|
| 38 | 38 | | An election ordered before the effective date of this Act is |
|---|
| 39 | 39 | | governed by the law in effect when the election was ordered. |
|---|
| 40 | 40 | | SECTION 5. This Act takes effect September 1, 2023. |
