66 AN ACT
77 relating to the establishment of the intellectual disabilities and
88 complex medical needs community support pilot program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0997 to read as follows:
1212 Sec. 531.0997. INTELLECTUAL DISABILITIES AND COMPLEX
1313 MEDICAL NEEDS COMMUNITY SUPPORT PILOT PROGRAM; REPORT ON PROGRAM.
1414 (a) In this section:
1515 (1) "Adult with a disability" means an individual who:
1616 (A) has an intelligence quotient of 69 or below;
1717 or
1818 (B) has an intelligence quotient of 75 or below
1919 and:
2020 (i) mild to severe deficits in adaptive
2121 behavior;
2222 (ii) a chronic or acute medical condition
2323 that requires continuous or frequent medical intervention; and
2424 (iii) a need for substantial assistance in
2525 meeting daily living needs.
2626 (2) "Group home" means a residential facility that
2727 provides support services to not more than four individuals with a
2828 disability.
2929 (3) "Intentional community" means a voluntary
3030 residential community that is designed to support a shared way of
3131 life and may include a cooperative housing community.
3232 (4) "Pilot program" means the intellectual
3333 disabilities and complex medical needs community support pilot
3434 program established under this section.
3535 (b) The executive commissioner by rule shall develop and
3636 implement a pilot program to award grants to nonprofit
3737 organizations for the purpose of increasing community-based
3838 housing options for adults who have a disability and complex
3939 medical needs by providing housing in intentional communities or
4040 group homes and community support. The program must be operated in
4141 two regions of this state, as determined by the commission.
4242 (c) An adult with a disability is eligible to receive
4343 housing in an intentional community or group home operated by a
4444 nonprofit organization under the pilot program if the individual:
4545 (1) is a resident of this state;
4646 (2) is at least 18 years of age;
4747 (3) is a Medicaid recipient or is eligible to receive
4848 Medicaid;
4949 (4) is considered medically fragile, as defined by
5050 commission rule; and
5151 (5) meets any other eligibility criteria the
5252 commission establishes.
5353 (d) The commission shall award grants to eligible nonprofit
5454 organizations that serve local intellectual and developmental
5555 disability authorities according to commission rules. Grant money
5656 awarded under the program may only be used by an organization to:
5757 (1) provide housing and services to adults with a
5858 disability;
5959 (2) cover an organization's costs related to
6060 participating in the program, including the:
6161 (A) costs of the construction of a group home or a
6262 residential home within an intentional community;
6363 (B) costs of the renovation of a group home or a
6464 residential home within an intentional community;
6565 (C) costs of recruiting and training employees
6666 to:
6767 (i) operate a group home or residential
6868 home within an intentional community; and
6969 (ii) provide services to an adult with a
7070 disability living in the home; and
7171 (D) supplemental costs of health care services
7272 provided by a licensed health care professional to an adult with a
7373 disability living in a home; and
7474 (3) to the extent allowed by federal law, provide
7575 Medicaid reimbursement at a rate set by the executive commissioner
7676 by rule for the recruitment and training of employees described by
7777 Subdivision (2)(C) and health care services provided under the
7878 pilot program.
7979 (e) Not later than November 1, 2028, the commission shall:
8080 (1) evaluate the effectiveness of the pilot program,
8181 considering:
8282 (A) the quality of the homes provided;
8383 (B) the quality of accessibility;
8484 (C) the number of adults with a disability served
8585 by a nonprofit organization;
8686 (D) the quality of care provided by the
8787 organizations;
8888 (E) whether the program is cost-effective;
8989 (F) how the program is integrated into the
9090 community; and
9191 (G) the satisfaction of program participants;
9292 and
9393 (2) submit a written report providing an evaluation of
9494 the pilot program and a recommendation regarding whether the
9595 program should be continued, modified, or terminated to the
9696 governor, the lieutenant governor, and the standing committees of
9797 the senate and house of representatives having primary jurisdiction
9898 over Medicaid.
9999 (f) The pilot program terminates and this section expires
100100 September 1, 2029.
101101 SECTION 2. As soon as practicable after the effective date
102102 of this Act, the Health and Human Services Commission shall adopt
103103 rules necessary to implement Section 531.0997, Government Code, as
104104 added by this Act.
105105 SECTION 3. If before implementing any provision of this Act
106106 a state agency determines that a waiver or authorization from a
107107 federal agency is necessary for implementation of that provision,
108108 the agency affected by the provision shall request the waiver or
109109 authorization and may delay implementing that provision until the
110110 waiver or authorization is granted.
111111 SECTION 4. This Act takes effect immediately if it receives
112112 a vote of two-thirds of all the members elected to each house, as
113113 provided by Section 39, Article III, Texas Constitution. If this
114114 Act does not receive the vote necessary for immediate effect, this
115115 Act takes effect September 1, 2023.
