55 AN ACT
66 relating to recommendations by local school health advisory
77 councils regarding opioid addiction and abuse education in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004(c), Education Code, is amended to
1111 read as follows:
1212 (c) The local school health advisory council's duties
1313 include recommending:
1414 (1) the number of hours of instruction to be provided
1515 in:
1616 (A) health education in kindergarten through
1717 grade eight; and
1818 (B) if the school district requires health
1919 education for high school graduation, health education, including
2020 physical health education and mental health education, in grades 9
2121 through 12;
2222 (2) policies, procedures, strategies, and curriculum
2323 appropriate for specific grade levels designed to prevent physical
2424 health concerns, including obesity, cardiovascular disease, Type 2
2525 diabetes, and mental health concerns, including suicide, through
2626 coordination of:
2727 (A) health education, which must address
2828 physical health concerns and mental health concerns to ensure the
2929 integration of physical health education and mental health
3030 education;
3131 (B) physical education and physical activity;
3232 (C) nutrition services;
3333 (D) parental involvement;
3434 (E) instruction on substance abuse prevention;
3535 (F) school health services, including mental
3636 health services;
3737 (G) a comprehensive school counseling program
3838 under Section 33.005;
3939 (H) a safe and healthy school environment; and
4040 (I) school employee wellness;
4141 (3) appropriate grade levels and methods of
4242 instruction for human sexuality instruction;
4343 (4) strategies for integrating the curriculum
4444 components specified by Subdivision (2) with the following elements
4545 in a coordinated school health program for the district:
4646 (A) school health services, including physical
4747 health services and mental health services, if provided at a campus
4848 by the district or by a third party under a contract with the
4949 district;
5050 (B) a comprehensive school counseling program
5151 under Section 33.005;
5252 (C) a safe and healthy school environment; and
5353 (D) school employee wellness;
5454 (5) if feasible, joint use agreements or strategies
5555 for collaboration between the school district and community
5656 organizations or agencies;
5757 (6) strategies to increase parental awareness
5858 regarding:
5959 (A) risky behaviors and early warning signs of
6060 suicide risks and behavioral health concerns, including mental
6161 health disorders and substance use disorders; and
6262 (B) available community programs and services
6363 that address risky behaviors, suicide risks, and behavioral health
6464 concerns;
6565 (7) appropriate grade levels and curriculum for
6666 instruction regarding the dangers of opioids, including
6767 instruction on:
6868 (A) opioid addiction and abuse, including
6969 addiction to and abuse of synthetic opioids such as fentanyl; and
7070 (B) methods of administering an opioid
7171 antagonist, as defined by Section 483.101, Health and Safety Code;
7272 and
7373 (8) appropriate grade levels and curriculum for
7474 instruction regarding child abuse, family violence, dating
7575 violence, and sex trafficking, including likely warning signs that
7676 a child may be at risk for sex trafficking, provided that the local
7777 school health advisory council's recommendations under this
7878 subdivision do not conflict with the essential knowledge and skills
7979 developed by the State Board of Education under this subchapter.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2023.
