66 relating to banning the transfer, distribution, sale of bump-fire
77 stock; creating a criminal offense;.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 46, Penal Code, is amended by adding new
1010 Section 46.16 to read as follow:
1111 Sec. 46.16. BUMP-STOCK CONVERSION KITS PROHIBITED. (a) A
1212 person may not import into this state or transfer, distribute,
1313 sell, keep for sale, offer for sale, possess, or give to another
1414 person a bump-fire stock.
1515 (b) A person who violates this section commits a Class A
1616 Misdemeanor.
1717 (c) As used in this section, the term "bump-fire stock"
1818 means a conversion kit, a tool, an accessory, or a device used to
1919 alter the rate of fire of a firearm to mimic automatic weapon fire
2020 or which is used to increase the rate of fire to a faster rate than
2121 is possible for a person to fire such semiautomatic firearm
2222 unassisted by a kit, a tool, an accessory, or a device.
2323 SECTION 2. The changes in law made by this Act apply only to
2424 an offense committed on or after the effective date of this Act. An
2525 offense committed before the effective date of this Act is governed
2626 by the law in effect on the date the offense was committed, and the
2727 former law is continued in effect for that purpose. For purposes of
2828 this subsection, an offense was committed before the effective date
2929 of this Act if any element of the offense was committed before that
3030 date.
3131 SECTION 3. This Act takes effect September 1, 2023.
