| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 46, Penal Code, is amended by adding new |
|---|
| 10 | 10 | | Section 46.16 to read as follow: |
|---|
| 11 | 11 | | Sec. 46.16. BUMP-STOCK CONVERSION KITS PROHIBITED. (a) A |
|---|
| 12 | 12 | | person may not import into this state or transfer, distribute, |
|---|
| 13 | 13 | | sell, keep for sale, offer for sale, possess, or give to another |
|---|
| 14 | 14 | | person a bump-fire stock. |
|---|
| 15 | 15 | | (b) A person who violates this section commits a Class A |
|---|
| 16 | 16 | | Misdemeanor. |
|---|
| 17 | 17 | | (c) As used in this section, the term "bump-fire stock" |
|---|
| 18 | 18 | | means a conversion kit, a tool, an accessory, or a device used to |
|---|
| 19 | 19 | | alter the rate of fire of a firearm to mimic automatic weapon fire |
|---|
| 20 | 20 | | or which is used to increase the rate of fire to a faster rate than |
|---|
| 21 | 21 | | is possible for a person to fire such semiautomatic firearm |
|---|
| 22 | 22 | | unassisted by a kit, a tool, an accessory, or a device. |
|---|
| 23 | 23 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 24 | 24 | | an offense committed on or after the effective date of this Act. An |
|---|
| 25 | 25 | | offense committed before the effective date of this Act is governed |
|---|
| 26 | 26 | | by the law in effect on the date the offense was committed, and the |
|---|
| 27 | 27 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 28 | 28 | | this subsection, an offense was committed before the effective date |
|---|
| 29 | 29 | | of this Act if any element of the offense was committed before that |
|---|
| 30 | 30 | | date. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
