55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirements for issuance of a driver's license or
88 learner license to a person younger than 18 years of age.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.204(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) The department may issue a Class C driver's license to
1313 an applicant under 18 years of age only if the applicant:
1414 (1) is 16 years of age or older;
1515 (2) has submitted to the department a driver education
1616 certificate issued under Section 1001.055, Education Code, that
1717 states that the person has completed and passed a driver education
1818 course approved by the Texas Department of Licensing and
1919 Regulation; and
2020 (3) [has obtained a high school diploma or its
2121 equivalent or is a student:
2222 [(A) enrolled in a public school, home school, or
2323 private school who attended school for at least 80 days in the fall
2424 or spring semester preceding the date of the driver's license
2525 application; or
2626 [(B) who has been enrolled for at least 45 days,
2727 and is enrolled as of the date of the application, in a program to
2828 prepare persons to pass the high school equivalency exam;
2929 [(4) has submitted to the department written parental
3030 or guardian permission:
3131 [(A) for the department to access the applicant's
3232 school enrollment records maintained by the Texas Education Agency;
3333 and
3434 [(B) for a school administrator or law
3535 enforcement officer to notify the department in the event that the
3636 person has been absent from school for at least 20 consecutive
3737 instructional days; and
3838 [(5)] has passed the examination required by Section
3939 521.161.
4040 SECTION 2. Section 521.222(a), Transportation Code, is
4141 amended to read as follows:
4242 (a) The department may issue a learner license, including a
4343 Class A or Class B driver's learner license, to a person who:
4444 (1) is 15 years of age or older but under 18 years of
4545 age;
4646 (2) has satisfactorily completed and passed the
4747 classroom phase of an approved driver education course, which may
4848 be a course taught under Section 1001.112, Education Code; and
4949 (3) [meets the requirements imposed under Section
5050 521.204(a)(3); and
5151 [(4)] has passed each examination required under
5252 Section 521.161 other than the driving test.
5353 SECTION 3. Section 521.003, Transportation Code, is
5454 repealed.
5555 SECTION 4. This Act takes effect September 1, 2023.
