| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 5, Water Code, is amended |
|---|
| 12 | 12 | | by adding Section 5.062 to read as follows: |
|---|
| 13 | 13 | | Sec. 5.062. CERTAIN EMPLOYMENT FOR FORMER EMPLOYEE |
|---|
| 14 | 14 | | RESTRICTED. A former employee of the commission may not accept |
|---|
| 15 | 15 | | employment in an industry regulated by the commission, as described |
|---|
| 16 | 16 | | in Section 5.013(a), before the second anniversary of the date the |
|---|
| 17 | 17 | | person ceased to be an employee of the commission. |
|---|
| 18 | 18 | | SECTION 2. Section 7.052, Water Code, is amended by adding |
|---|
| 19 | 19 | | Subsection (b-5) to read as follows: |
|---|
| 20 | 20 | | (b-5) A person who hires a former employee of the commission |
|---|
| 21 | 21 | | in violation of Section 5.062 is subject to an administrative |
|---|
| 22 | 22 | | penalty not to exceed an amount that is equal to three times the |
|---|
| 23 | 23 | | employee's salary for the position hired. |
|---|
| 24 | 24 | | SECTION 3. Section 5.062, Water Code, as added by this Act, |
|---|
| 25 | 25 | | applies only to a person who ceases to be an employee of the Texas |
|---|
| 26 | 26 | | Commission on Environmental Quality on or after the effective date |
|---|
| 27 | 27 | | of this Act. |
|---|
| 28 | 28 | | SECTION 4. This Act takes effect September 1, 2023. |
