55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to standards to qualify as a licensed specialist in school
88 psychology.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 501.260, Occupations Code, is amended by
1111 amending Subsection (b) and adding Subsection (b-1) to read as
1212 follows:
1313 (b) The executive council shall set the standards to qualify
1414 for a license under this section. The standards must include:
1515 (1) satisfaction of minimum recognized graduate
1616 degree requirements;
1717 (2) completion of graduate course work at a regionally
1818 accredited institution of higher education in:
1919 (A) psychological foundations;
2020 (B) educational foundations;
2121 (C) interventions;
2222 (D) assessments; and
2323 (E) professional issues and ethics;
2424 (3) completion of at least 1,200 hours of supervised
2525 experience;
2626 (4) proficiency in the practice of school psychology
2727 as demonstrated by:
2828 (A) receipt of a passing score on a nationally
2929 recognized qualifying examination determined to be appropriate by
3030 the executive council and on any other examination required by the
3131 executive council; or
3232 (B) active certification as a nationally
3333 certified school psychologist by the National Association of School
3434 Psychologists or a successor organization; and
3535 (5) satisfaction of the requirements under Sections
3636 501.2525(a)(3)-(9).
3737 (b-1) The executive council may not set a standard to
3838 qualify for a license under this section that requires a person who
3939 meets the standard set by the executive council corresponding to
4040 Subsection (b)(4)(B) to complete any examination, including an
4141 examination regarding jurisprudence.
4242 SECTION 2. Section 501.260, Occupations Code, as amended by
4343 this Act, applies only to an application for a license submitted
4444 under that section on or after the effective date of this Act. An
4545 application submitted before the effective date of this Act is
4646 governed by the law in effect on the date the application was
4747 submitted, and the former law is continued in effect for that
4848 purpose.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2023.
