55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to required reporting regarding a school district's
88 program for gifted and talented students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 29, Education Code, is
1111 amended by adding Section 29.124 to read as follows:
1212 Sec. 29.124. PEIMS REPORTING REQUIREMENTS. Each school
1313 district shall include the following information in the district's
1414 Public Education Information Management System (PEIMS) report:
1515 (1) the name and contact information of the district
1616 administrator responsible for ensuring that the district is in
1717 compliance with this subchapter;
1818 (2) whether the district uses data from an entire
1919 grade level to identify gifted and talented students; and
2020 (3) if applicable, the grade levels for which the
2121 district identifies gifted and talented students as described by
2222 Subdivision (2).
2323 SECTION 2. Section 39.306, Education Code, is amended by
2424 amending Subsection (d-1) and adding Subsection (d-2) to read as
2525 follows:
2626 (d-1) The comparison provided by the agency under
2727 Subsection (d) must include a comparison of college, career, and
2828 military readiness achievement between students served in a program
2929 for gifted and talented students and students served in other
3030 programs.
3131 (d-2) The report must also include the number of school
3232 counselors providing counseling services at each campus.
3333 SECTION 3. This Act applies beginning with the 2023-2024
3434 school year.
3535 SECTION 4. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2023.
