55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on the effects of providing child life
88 specialist services to certain individuals who receive supportive
99 palliative care.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITIONS. In this Act:
1212 (1) "Advisory council" means the Palliative Care
1313 Interdisciplinary Advisory Council established under Chapter 118,
1414 Health and Safety Code.
1515 (2) "Child life specialist" means a health care
1616 provider that offers psychosocial support to pediatric patients and
1717 to the children of seriously ill adult patients by helping improve a
1818 child's coping skills, aiding in the development of holistic pain
1919 management and other symptom management strategies for pediatric
2020 patients, and improving the overall patient experience.
2121 (3) "Commission" means the Health and Human Services
2222 Commission.
2323 SECTION 2. STUDY REGARDING CHILD LIFE SPECIALIST SERVICES.
2424 (a) The commission, in collaboration with the advisory council,
2525 shall conduct a study to assess the effects of supporting the use of
2626 child life specialist services by or providing child life
2727 specialist services to adult and child Medicaid recipients in this
2828 state who receive supportive palliative care in inpatient or
2929 community-based settings, including:
3030 (1) potential improvements to recipients' health care
3131 outcomes and quality of life; and
3232 (2) anticipated cost savings to this state.
3333 (b) The study must identify:
3434 (1) the role child life specialists currently play in
3535 providing supportive palliative care services to individuals,
3636 including Medicaid recipients, in inpatient and community-based
3737 settings in this state;
3838 (2) the current funding method for child life
3939 specialist positions;
4040 (3) opportunities for increasing the use of child life
4141 specialist services in this state; and
4242 (4) best practices for using child life specialist
4343 services as developed by other states.
4444 (c) The advisory council shall provide recommendations to
4545 the commission regarding the structure and goals of the study,
4646 including recommendations for:
4747 (1) specific populations to receive supportive
4848 palliative care under Medicaid;
4949 (2) variables and outcomes to measure in the study;
5050 and
5151 (3) entities, including hospitals, hospices, and home
5252 health agencies, with which the commission may collaborate to
5353 conduct the study.
5454 (d) The commission may:
5555 (1) collaborate with private and public entities as
5656 necessary to conduct the study; and
5757 (2) solicit and accept gifts, grants, and donations
5858 from any public or private source to fund the study.
5959 SECTION 3. REPORT TO ADVISORY COUNCIL AND LEGISLATURE. (a)
6060 Not later than September 1, 2026, the commission shall prepare and
6161 submit to the advisory council a report on the results of the study
6262 conducted under this Act.
6363 (b) The advisory council shall include the commission's
6464 report under Subsection (a) of this section in the advisory
6565 council's 2026 biennial report to the legislature required by
6666 Section 118.010, Health and Safety Code.
6767 SECTION 4. EXPIRATION. This Act expires December 31, 2026.
6868 SECTION 5. EFFECTIVE DATE. This Act takes effect
6969 immediately if it receives a vote of two-thirds of all the members
7070 elected to each house, as provided by Section 39, Article III, Texas
7171 Constitution. If this Act does not receive the vote necessary for
7272 immediate effect, this Act takes effect September 1, 2023.
