1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the identification of and prohibited cooperation by
1414 state and local entities with certain federal acts that violate the
1515 United States Constitution.
1616 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1717 SECTION 1. Title 7, Government Code, is amended by adding
1818 Chapter 794 to read as follows:
1919 CHAPTER 794. IDENTIFICATION OF AND PROHIBITED COOPERATION WITH
2020 CERTAIN UNCONSTITUTIONAL ACTS OF FEDERAL GOVERNMENT
2121 Sec. 794.001. DEFINITIONS. In this chapter:
2222 (1) "Political subdivision" has the meaning assigned
2323 by Section 791.003.
2424 (2) "State agency" has the meaning assigned by Section
2525 751.001.
2626 Sec. 794.002. REVIEW OF EXECUTIVE ORDERS. (a) On the last
2727 day of each month, the attorney general shall provide a written
2828 report to the governor, lieutenant governor, speaker of the house
2929 of representatives, and each member of the legislature that:
3030 (1) identifies each rule adopted by a federal
3131 government agency during the previous month that:
3232 (A) relates to:
3333 (i) pandemics or other health emergencies;
3434 (ii) the regulation of natural resources,
3535 including coal and oil;
3636 (iii) the regulation of the agriculture
3737 industry;
3838 (iv) the use of land;
3939 (v) the regulation of the financial sector
4040 as it relates to environmental, social, or governance standards;
4141 (vi) the regulation of the constitutional
4242 right to keep and bear arms;
4343 (vii) the free exercise of religion,
4444 including the congregating of religious practitioners;
4545 (viii) border security; or
4646 (ix) transportation;
4747 (B) was adopted in response to an executive order
4848 by the president of the United States; and
4949 (C) violates the rights guaranteed to the
5050 citizens of the United States by the United States Constitution;
5151 and
5252 (2) provides the status of any lawsuit filed against
5353 the federal government relating to a rule identified by any report
5454 prepared under this section, including whether a court has found
5555 the rule to violate the rights guaranteed to the citizens of the
5656 United States by the United States Constitution.
5757 (b) The attorney general shall publish any report prepared
5858 under this section on the attorney general's Internet website and
5959 in the Texas Register.
6060 Sec. 794.003. COOPERATION WITH UNCONSTITUTIONAL ACTS.
6161 Notwithstanding any other law, a state agency or political
6262 subdivision may not cooperate with a federal government agency in
6363 implementing an agency rule that a report published under Section
6464 794.002 indicates has been found by a federal court in a decision
6565 that has not been stayed, reversed, or overruled to violate the
6666 rights guaranteed to the citizens of the United States by the United
6767 States Constitution.
6868 Sec. 794.004. INJUNCTIVE RELIEF. The attorney general may
6969 bring an action in a district court in Travis County or in a county
7070 in which the political subdivision is located to enjoin a violation
7171 of Section 794.003.
7272 SECTION 2. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2023.
