7 | 7 | | relating to required reporting by the Department of Family and |
---|
8 | 8 | | Protective Services regarding youth in the managing |
---|
9 | 9 | | conservatorship of the department who attempt suicide. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 264.017(b), Family Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (b) The department shall provide the report required by |
---|
14 | 14 | | Subsection (a) to the legislature and shall publish the report and |
---|
15 | 15 | | make the report available electronically to the public not later |
---|
16 | 16 | | than February 1 of each year. The report must include, with respect |
---|
17 | 17 | | to the preceding year: |
---|
18 | 18 | | (1) information on the number and disposition of |
---|
19 | 19 | | reports of child abuse and neglect received by the department; |
---|
20 | 20 | | (2) information on the number of clients for whom the |
---|
21 | 21 | | department took protective action, including investigations, |
---|
22 | 22 | | alternative responses, and court-ordered removals; |
---|
23 | 23 | | (3) information on the number of clients for whom the |
---|
24 | 24 | | department provided services in each program administered by the |
---|
25 | 25 | | child protective services division, including investigations, |
---|
26 | 26 | | alternative responses, family-based safety services, |
---|
27 | 27 | | conservatorship, post-adoption services, and transitional living |
---|
28 | 28 | | services; |
---|
29 | 29 | | (4) the number of children in this state who died as a |
---|
30 | 30 | | result of child abuse or neglect; |
---|
31 | 31 | | (5) the number of children described by Subdivision |
---|
32 | 32 | | (4) for whom the department was the children's managing conservator |
---|
33 | 33 | | at the time of death; |
---|
34 | 34 | | (6) information on the timeliness of the department's |
---|
35 | 35 | | initial contact in an investigation or alternative response; |
---|
36 | 36 | | (7) information on the response time by the department |
---|
37 | 37 | | in commencing services to families and children for whom an |
---|
38 | 38 | | allegation of child abuse or neglect has been made; |
---|
39 | 39 | | (8) information regarding child protection staffing |
---|
40 | 40 | | and caseloads by program area; |
---|
41 | 41 | | (9) information on the permanency goals in place and |
---|
42 | 42 | | achieved for children in the managing conservatorship of the |
---|
43 | 43 | | department, including information on the timeliness of achieving |
---|
44 | 44 | | the goals, the stability of the children's placement in foster |
---|
45 | 45 | | care, and the proximity of placements to the children's home |
---|
46 | 46 | | counties; |
---|
47 | 47 | | (10) the number of children who suffer from a severe |
---|
48 | 48 | | emotional disturbance and for whom the department is appointed |
---|
49 | 49 | | managing conservator, including statistics on appointments as |
---|
50 | 50 | | joint managing conservator, due to an individual voluntarily |
---|
51 | 51 | | relinquishing custody of a child solely to obtain mental health |
---|
52 | 52 | | services for the child; |
---|
53 | 53 | | (11) the number of children who are pregnant or a |
---|
54 | 54 | | parent while in the managing conservatorship of the department and |
---|
55 | 55 | | the number of the children born to a parent in the managing |
---|
56 | 56 | | conservatorship of the department who are placed in the managing |
---|
57 | 57 | | conservatorship of the department; |
---|
58 | 58 | | (12) the number of children who are missing from the |
---|
59 | 59 | | children's substitute care provider while in the managing |
---|
60 | 60 | | conservatorship of the department; [and] |
---|
61 | 61 | | (13) the number of children who were victims of |
---|
62 | 62 | | trafficking under Chapter 20A, Penal Code, while in the managing |
---|
63 | 63 | | conservatorship of the department; and |
---|
64 | 64 | | (14) the number of children who attempted suicide |
---|
65 | 65 | | while in the managing conservatorship of the department. |
---|
66 | 66 | | SECTION 2. Section 264.018(a)(4), Family Code, is amended |
---|
67 | 67 | | to read as follows: |
---|
68 | 68 | | (4) "Significant change in medical condition" means |
---|
69 | 69 | | the occurrence of an injury or the onset of an illness that is |
---|
70 | 70 | | life-threatening or may have serious long-term health |
---|
71 | 71 | | consequences. The term includes: |
---|
72 | 72 | | (A) the occurrence or onset of an injury or |
---|
73 | 73 | | illness that requires hospitalization for surgery or another |
---|
74 | 74 | | procedure that is not minor emergency care; and |
---|
75 | 75 | | (B) a suicide attempt. |
---|
76 | 76 | | SECTION 3. This Act takes effect September 1, 2023. |
