55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to required reporting by the Department of Family and
88 Protective Services regarding youth in the managing
99 conservatorship of the department who attempt suicide.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 264.017(b), Family Code, is amended to
1212 read as follows:
1313 (b) The department shall provide the report required by
1414 Subsection (a) to the legislature and shall publish the report and
1515 make the report available electronically to the public not later
1616 than February 1 of each year. The report must include, with respect
1717 to the preceding year:
1818 (1) information on the number and disposition of
1919 reports of child abuse and neglect received by the department;
2020 (2) information on the number of clients for whom the
2121 department took protective action, including investigations,
2222 alternative responses, and court-ordered removals;
2323 (3) information on the number of clients for whom the
2424 department provided services in each program administered by the
2525 child protective services division, including investigations,
2626 alternative responses, family-based safety services,
2727 conservatorship, post-adoption services, and transitional living
2828 services;
2929 (4) the number of children in this state who died as a
3030 result of child abuse or neglect;
3131 (5) the number of children described by Subdivision
3232 (4) for whom the department was the children's managing conservator
3333 at the time of death;
3434 (6) information on the timeliness of the department's
3535 initial contact in an investigation or alternative response;
3636 (7) information on the response time by the department
3737 in commencing services to families and children for whom an
3838 allegation of child abuse or neglect has been made;
3939 (8) information regarding child protection staffing
4040 and caseloads by program area;
4141 (9) information on the permanency goals in place and
4242 achieved for children in the managing conservatorship of the
4343 department, including information on the timeliness of achieving
4444 the goals, the stability of the children's placement in foster
4545 care, and the proximity of placements to the children's home
4646 counties;
4747 (10) the number of children who suffer from a severe
4848 emotional disturbance and for whom the department is appointed
4949 managing conservator, including statistics on appointments as
5050 joint managing conservator, due to an individual voluntarily
5151 relinquishing custody of a child solely to obtain mental health
5252 services for the child;
5353 (11) the number of children who are pregnant or a
5454 parent while in the managing conservatorship of the department and
5555 the number of the children born to a parent in the managing
5656 conservatorship of the department who are placed in the managing
5757 conservatorship of the department;
5858 (12) the number of children who are missing from the
5959 children's substitute care provider while in the managing
6060 conservatorship of the department; [and]
6161 (13) the number of children who were victims of
6262 trafficking under Chapter 20A, Penal Code, while in the managing
6363 conservatorship of the department; and
6464 (14) the number of children who attempted suicide
6565 while in the managing conservatorship of the department.
6666 SECTION 2. Section 264.018(a)(4), Family Code, is amended
6767 to read as follows:
6868 (4) "Significant change in medical condition" means
6969 the occurrence of an injury or the onset of an illness that is
7070 life-threatening or may have serious long-term health
7171 consequences. The term includes:
7272 (A) the occurrence or onset of an injury or
7373 illness that requires hospitalization for surgery or another
7474 procedure that is not minor emergency care; and
7575 (B) a suicide attempt.
7676 SECTION 3. This Act takes effect September 1, 2023.
