55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an exemption from residential mortgage loan originator
88 licensing requirements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 157.0121(b), Finance Code, is amended to
1111 read as follows:
1212 (b) The following individuals are exempt from this chapter:
1313 (1) a registered mortgage loan originator when acting
1414 for:
1515 (A) a depository institution;
1616 (B) a subsidiary of a depository institution that
1717 is:
1818 (i) owned and controlled by the depository
1919 institution; and
2020 (ii) regulated by a federal banking agency;
2121 or
2222 (C) an institution regulated by the Farm Credit
2323 Administration;
2424 (2) an individual who offers or negotiates the terms
2525 of a residential mortgage loan with or on behalf of an immediate
2626 family member of the individual;
2727 (3) a licensed attorney who negotiates the terms of a
2828 residential mortgage loan on behalf of a client as an ancillary
2929 matter to the attorney's representation of the client, unless the
3030 attorney:
3131 (A) takes a residential mortgage loan
3232 application; and
3333 (B) offers or negotiates the terms of a
3434 residential mortgage loan;
3535 (4) an individual who offers or negotiates terms of a
3636 residential mortgage loan secured by a dwelling that serves as the
3737 individual's residence;
3838 (5) any owner of residential real estate who in any
3939 12-consecutive-month period makes no more than three [five]
4040 residential mortgage loans to purchasers of the property for all or
4141 part of the purchase price of the residential real estate against
4242 which the mortgage is secured; and
4343 (6) an individual who is exempt as provided by Section
4444 180.003(b).
4545 SECTION 2. This Act takes effect September 1, 2023.
