66 AN ACT
77 relating to the requirements for issuance of a supplemental
88 bilingual education teaching certificate.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 21, Education Code, is
1111 amended by adding Section 21.04892 to read as follows:
1212 Sec. 21.04892. REQUIREMENTS FOR BILINGUAL EDUCATION
1313 SUPPLEMENTAL CERTIFICATION. (a) The board shall propose rules to
1414 ensure that in issuing the teaching certificates appropriate for
1515 bilingual education instruction in accordance with Section
1616 29.061(a), the board issues bifurcated supplemental certificates
1717 in bilingual education instruction that, combined with a teacher's
1818 primary certificate, certify the teacher to provide bilingual
1919 education instruction to students in sixth grade and below or
2020 students in 7th through 12th grade, as applicable. The bifurcated
2121 supplemental certificates must be tailored to providing bilingual
2222 education instruction in the applicable grades to which the
2323 teacher's primary certificate applies.
2424 (b) The rules proposed by the board shall allow a person
2525 seeking certification described by Subsection (a) who fails to
2626 perform satisfactorily on the required Bilingual Target Language
2727 Proficiency Test to:
2828 (1) retake only the sections of the test that include
2929 the domains on which the person failed to perform satisfactorily;
3030 and
3131 (2) during a retake of the test described by
3232 Subdivision (1), demonstrate the person's language proficiency
3333 through the completion of fewer components, including eliminating a
3434 component that requires the preparation of a lesson plan for a
3535 person who fails to perform satisfactorily on a domain requiring
3636 completion of that component.
3737 SECTION 2. As soon as practicable after the effective date
3838 of this Act, the State Board for Educator Certification shall
3939 propose rules prescribing the requirements for a supplemental
4040 educator certification in bilingual education instruction as
4141 provided by Section 21.04892, Education Code, as added by this Act.
4242 SECTION 3. This Act takes effect September 1, 2023.
