| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 21, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 21.04892 to read as follows: |
|---|
| 12 | 12 | | Sec. 21.04892. REQUIREMENTS FOR BILINGUAL EDUCATION |
|---|
| 13 | 13 | | SUPPLEMENTAL CERTIFICATION. (a) The board shall propose rules to |
|---|
| 14 | 14 | | ensure that in issuing the teaching certificates appropriate for |
|---|
| 15 | 15 | | bilingual education instruction in accordance with Section |
|---|
| 16 | 16 | | 29.061(a), the board issues bifurcated supplemental certificates |
|---|
| 17 | 17 | | in bilingual education instruction that, combined with a teacher's |
|---|
| 18 | 18 | | primary certificate, certify the teacher to provide bilingual |
|---|
| 19 | 19 | | education instruction to students in sixth grade and below or |
|---|
| 20 | 20 | | students in 7th through 12th grade, as applicable. The bifurcated |
|---|
| 21 | 21 | | supplemental certificates must be tailored to providing bilingual |
|---|
| 22 | 22 | | education instruction in the applicable grades to which the |
|---|
| 23 | 23 | | teacher's primary certificate applies. |
|---|
| 24 | 24 | | (b) The rules proposed by the board shall allow a person |
|---|
| 25 | 25 | | seeking certification described by Subsection (a) who fails to |
|---|
| 26 | 26 | | perform satisfactorily on the required Bilingual Target Language |
|---|
| 27 | 27 | | Proficiency Test to: |
|---|
| 28 | 28 | | (1) retake only the sections of the test that include |
|---|
| 29 | 29 | | the domains on which the person failed to perform satisfactorily; |
|---|
| 30 | 30 | | and |
|---|
| 31 | 31 | | (2) during a retake of the test described by |
|---|
| 32 | 32 | | Subdivision (1), demonstrate the person's language proficiency |
|---|
| 33 | 33 | | through the completion of fewer components, including eliminating a |
|---|
| 34 | 34 | | component that requires the preparation of a lesson plan for a |
|---|
| 35 | 35 | | person who fails to perform satisfactorily on a domain requiring |
|---|
| 36 | 36 | | completion of that component. |
|---|
| 37 | 37 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 38 | 38 | | of this Act, the State Board for Educator Certification shall |
|---|
| 39 | 39 | | propose rules prescribing the requirements for a supplemental |
|---|
| 40 | 40 | | educator certification in bilingual education instruction as |
|---|
| 41 | 41 | | provided by Section 21.04892, Education Code, as added by this Act. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2023. |
