66 AN ACT
77 relating to the security of the electricity supply chain.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Subchapter F, Chapter 38,
1010 Utilities Code, is amended to read as follows:
1111 SUBCHAPTER F. [TEXAS] ELECTRICITY SUPPLY CHAIN SECURITY AND MAPPING
1212 [COMMITTEE]
1313 SECTION 2. Section 38.201(c), Utilities Code, is amended to
1414 read as follows:
1515 (c) The committee is composed of:
1616 (1) the executive director of the commission;
1717 (2) the executive director of the Railroad Commission
1818 of Texas;
1919 (3) the president and the chief executive officer of
2020 the independent organization certified under Section 39.151 for the
2121 ERCOT power region; [and]
2222 (4) the public safety director of the Department of
2323 Public Safety; and
2424 (5) the chief of the Texas Division of Emergency
2525 Management.
2626 SECTION 3. Subchapter F, Chapter 38, Utilities Code, is
2727 amended by adding Section 38.205 to read as follows:
2828 Sec. 38.205. PHYSICAL SECURITY OF SUBSTATIONS. (a) The
2929 commission shall require each electric cooperative, municipally
3030 owned utility, and transmission and distribution utility to include
3131 in the cooperative's or utility's emergency operations plan
3232 described by Section 186.007 information about the physical
3333 security of the cooperative's or utility's critical substations and
3434 contact information for each law enforcement agency with
3535 jurisdiction over the critical substations.
3636 (b) The commission shall provide the Department of Public
3737 Safety with access to the information described by Subsection (a).
3838 (c) Information provided to the commission or the
3939 Department of Public Safety under this section is confidential
4040 under Section 418.181, Government Code, and not subject to
4141 disclosure under Chapter 552, Government Code.
4242 SECTION 4. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2023.
