| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Subchapter F, Chapter 38, |
|---|
| 10 | 10 | | Utilities Code, is amended to read as follows: |

| 11 | 11 | | SUBCHAPTER F. [TEXAS] ELECTRICITY SUPPLY CHAIN SECURITY AND MAPPING |

| 13 | 13 | | SECTION 2. Section 38.201(c), Utilities Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (c) The committee is composed of: |
|---|
| 16 | 16 | | (1) the executive director of the commission; |
|---|
| 17 | 17 | | (2) the executive director of the Railroad Commission |
|---|
| 18 | 18 | | of Texas; |
|---|
| 19 | 19 | | (3) the president and the chief executive officer of |
|---|
| 20 | 20 | | the independent organization certified under Section 39.151 for the |
|---|
| 21 | 21 | | ERCOT power region; [and] |
|---|
| 22 | 22 | | (4) the public safety director of the Department of |
|---|
| 23 | 23 | | Public Safety; and |
|---|
| 24 | 24 | | (5) the chief of the Texas Division of Emergency |
|---|
| 25 | 25 | | Management. |

| 26 | 26 | | SECTION 3. Subchapter F, Chapter 38, Utilities Code, is |
|---|
| 27 | 27 | | amended by adding Section 38.205 to read as follows: |
|---|
| 28 | 28 | | Sec. 38.205. PHYSICAL SECURITY OF SUBSTATIONS. (a) The |
|---|
| 29 | 29 | | commission shall require each electric cooperative, municipally |
|---|
| 30 | 30 | | owned utility, and transmission and distribution utility to include |
|---|
| 31 | 31 | | in the cooperative's or utility's emergency operations plan |
|---|
| 32 | 32 | | described by Section 186.007 information about the physical |
|---|
| 33 | 33 | | security of the cooperative's or utility's critical substations and |
|---|
| 34 | 34 | | contact information for each law enforcement agency with |
|---|
| 35 | 35 | | jurisdiction over the critical substations. |
|---|
| 36 | 36 | | (b) The commission shall provide the Department of Public |
|---|
| 37 | 37 | | Safety with access to the information described by Subsection (a). |
|---|
| 38 | 38 | | (c) Information provided to the commission or the |
|---|
| 39 | 39 | | Department of Public Safety under this section is confidential |
|---|
| 40 | 40 | | under Section 418.181, Government Code, and not subject to |
|---|
| 41 | 41 | | disclosure under Chapter 552, Government Code. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2023. |
