7 | 7 | | drug treatment unit by a narcotic drug treatment program facility; |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 466, Health and Safety Code, is amended by |
---|
11 | 11 | | adding Subchapter B-1 to read as follows: |
---|
12 | 12 | | SUBCHAPTER B-1. MOBILE NARCOTIC DRUG TREATMENT UNITS |
---|
13 | 13 | | Sec. 466.031. DEFINITION. In this subchapter, "mobile |
---|
14 | 14 | | unit" means a motor vehicle that is operated by a narcotic drug |
---|
15 | 15 | | treatment program facility to provide services under the narcotic |
---|
16 | 16 | | drug treatment program. |
---|
17 | 17 | | Sec. 466.032. MOBILE UNIT REGISTRATION. (a) A facility |
---|
18 | 18 | | that holds a permit under this chapter may operate one or more |
---|
19 | 19 | | mobile units to provide services under a narcotic drug treatment |
---|
20 | 20 | | program. |
---|
21 | 21 | | (b) A facility must register each mobile unit with the |
---|
22 | 22 | | department but is not required to obtain a separate permit for a |
---|
23 | 23 | | mobile unit. |
---|
24 | 24 | | (c) The executive commissioner may adopt rules setting a fee |
---|
25 | 25 | | for registration of a mobile unit under this section. The fee must |
---|
26 | 26 | | be in an amount sufficient to recover the actual expenditures of |
---|
27 | 27 | | state funds by the department to register and inspect the mobile |
---|
28 | 28 | | units. |
---|
29 | 29 | | (d) A mobile unit registered under this section is subject to |
---|
30 | 30 | | inspection in the same manner as a facility inspection provided by |
---|
31 | 31 | | Section 466.025. |
---|
32 | 32 | | Sec. 466.033. SERVICES. (a) Notwithstanding any other |
---|
33 | 33 | | provision of this chapter or any rule adopted under this chapter, a |
---|
34 | 34 | | mobile unit may provide administrative, medical, and psychological |
---|
35 | 35 | | service that are related to the narcotic drug treatment program's |
---|
36 | 36 | | goals, including: |
---|
37 | 37 | | (1) case management; |
---|
38 | 38 | | (2) counseling; and |
---|
39 | 39 | | (3) physician examinations. |
---|
40 | 40 | | (b) The mobile unit may collect samples, including but not |
---|
41 | 41 | | limited to blood, saliva, or urine, for the purpose of narcotic drug |
---|
42 | 42 | | testing or analysis. |
---|
43 | 43 | | (c) The mobile unit may dispense or administer an approved |
---|
44 | 44 | | narcotic drug for the maintenance or detoxification of persons with |
---|
45 | 45 | | a drug dependency as part of a narcotic drug program permitted by |
---|
46 | 46 | | the department. |
---|
47 | 47 | | (d) The mobile unit may provide the services described by |
---|
48 | 48 | | Subsection (a) regardless of whether those services are provided or |
---|
49 | 49 | | authorized to be provided in the narcotic drug treatment program's |
---|
50 | 50 | | permitted facility. |
---|
51 | 51 | | Sec. 466.034. RULES. The executive commissioner may not |
---|
52 | 52 | | adopt a rule that limits a mobile unit to assisting or treating only |
---|
53 | 53 | | established or stabilized patients. |
---|
54 | 54 | | SECTION 2. As soon as practicable after the effective date |
---|
55 | 55 | | of this Act, the executive commissioner of the Health and Human |
---|
56 | 56 | | Services Commission shall adopt rules necessary to implement the |
---|
57 | 57 | | changes in law made by this Act. |
---|
58 | 58 | | SECTION 3. This Act takes effect September 1, 2023. |
