55 AN ACT
66 relating to the establishment and operation of a mobile narcotic
77 drug treatment unit by a narcotic drug treatment program facility;
88 authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 466, Health and Safety Code, is amended by
1111 adding Subchapter B-1 to read as follows:
1212 SUBCHAPTER B-1. MOBILE NARCOTIC DRUG TREATMENT UNITS
1313 Sec. 466.031. DEFINITION. In this subchapter, "mobile
1414 unit" means a motor vehicle that is operated by a narcotic drug
1515 treatment program facility to provide services under the narcotic
1616 drug treatment program.
1717 Sec. 466.032. MOBILE UNIT REGISTRATION. (a) A facility
1818 that holds a permit under this chapter may operate one or more
1919 mobile units to provide services under a narcotic drug treatment
2020 program.
2121 (b) A facility must register each mobile unit with the
2222 department but is not required to obtain a separate permit for a
2323 mobile unit.
2424 (c) The executive commissioner may adopt rules setting a fee
2525 for registration of a mobile unit under this section. The fee must
2626 be in an amount sufficient to recover the actual expenditures of
2727 state funds by the department to register and inspect the mobile
2828 units.
2929 (d) A mobile unit registered under this section is subject to
3030 inspection in the same manner as a facility inspection provided by
3131 Section 466.025.
3232 Sec. 466.033. SERVICES. (a) Notwithstanding any other
3333 provision of this chapter or any rule adopted under this chapter, a
3434 mobile unit may provide administrative, medical, and psychological
3535 service that are related to the narcotic drug treatment program's
3636 goals, including:
3737 (1) case management;
3838 (2) counseling; and
3939 (3) physician examinations.
4040 (b) The mobile unit may collect samples, including but not
4141 limited to blood, saliva, or urine, for the purpose of narcotic drug
4242 testing or analysis.
4343 (c) The mobile unit may dispense or administer an approved
4444 narcotic drug for the maintenance or detoxification of persons with
4545 a drug dependency as part of a narcotic drug program permitted by
4646 the department.
4747 (d) The mobile unit may provide the services described by
4848 Subsection (a) regardless of whether those services are provided or
4949 authorized to be provided in the narcotic drug treatment program's
5050 permitted facility.
5151 Sec. 466.034. RULES. The executive commissioner may not
5252 adopt a rule that limits a mobile unit to assisting or treating only
5353 established or stabilized patients.
5454 SECTION 2. As soon as practicable after the effective date
5555 of this Act, the executive commissioner of the Health and Human
5656 Services Commission shall adopt rules necessary to implement the
5757 changes in law made by this Act.
5858 SECTION 3. This Act takes effect September 1, 2023.
