6 | 6 | | relating to a study regarding available beds at inpatient mental |
---|
7 | 7 | | health facilities providing acute psychiatric treatment. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
9 | 9 | | SECTION 1. (a) In this section, "commission" means the |
---|
10 | 10 | | Health and Human Services Commission. |
---|
11 | 11 | | (b) The commission shall conduct a study regarding the |
---|
12 | 12 | | availability of beds at inpatient mental health facilities in this |
---|
13 | 13 | | state that provide acute inpatient psychiatric treatment. The |
---|
14 | 14 | | study must evaluate: |
---|
15 | 15 | | (1) the current number of psychiatric beds available |
---|
16 | 16 | | at inpatient mental health facilities in this state that provide |
---|
17 | 17 | | inpatient psychiatric treatment to individuals experiencing an |
---|
18 | 18 | | acute mental health crisis, including a breakdown of beds available |
---|
19 | 19 | | for patients: |
---|
20 | 20 | | (A) committed to a facility for competency |
---|
21 | 21 | | restoration services under Chapter 46B, Code of Criminal Procedure; |
---|
22 | 22 | | (B) civilly committed to a facility under Chapter |
---|
23 | 23 | | 841, Health and Safety Code; |
---|
24 | 24 | | (C) committed to a facility after having been |
---|
25 | 25 | | found not guilty by reason of insanity under Chapter 46C, Code of |
---|
26 | 26 | | Criminal Procedure; |
---|
27 | 27 | | (D) voluntarily admitted to a facility; |
---|
28 | 28 | | (E) 18 years of age or older; |
---|
29 | 29 | | (F) younger than 18 years of age; and |
---|
30 | 30 | | (G) receiving long-term mental health treatment |
---|
31 | 31 | | in a facility; |
---|
32 | 32 | | (2) the current number of patients admitted to an |
---|
33 | 33 | | inpatient mental health facility in this state that provides |
---|
34 | 34 | | inpatient psychiatric treatment to individuals experiencing an |
---|
35 | 35 | | acute mental health crisis, including a breakdown of: |
---|
36 | 36 | | (A) the number of patients committed to a |
---|
37 | 37 | | facility for competency restoration services under Chapter 46B, |
---|
38 | 38 | | Code of Criminal Procedure, including the number of individuals |
---|
39 | 39 | | committed under an initial order of commitment or an order |
---|
40 | 40 | | extending the initial restoration period; |
---|
41 | 41 | | (B) the number of patients civilly committed to a |
---|
42 | 42 | | facility under Chapter 841, Health and Safety Code; |
---|
43 | 43 | | (C) the number of patients committed to a |
---|
44 | 44 | | facility after having been found not guilty by reason of insanity |
---|
45 | 45 | | under Chapter 46C, Code of Criminal Procedure; |
---|
46 | 46 | | (D) the number of patients voluntarily admitted |
---|
47 | 47 | | to a facility; |
---|
48 | 48 | | (E) the number of patients 18 years of age or |
---|
49 | 49 | | older; |
---|
50 | 50 | | (F) the number of patients younger than 18 years |
---|
51 | 51 | | of age; |
---|
52 | 52 | | (G) the percentage of patients in this state who |
---|
53 | 53 | | will likely require long-term mental health treatment in a |
---|
54 | 54 | | facility; and |
---|
55 | 55 | | (H) the number of patients who have been |
---|
56 | 56 | | diagnosed with an intellectual or developmental disability; |
---|
57 | 57 | | (3) the projected need over the next several years for |
---|
58 | 58 | | additional psychiatric beds at inpatient mental health facilities |
---|
59 | 59 | | that provide inpatient psychiatric treatment to individuals |
---|
60 | 60 | | experiencing an acute mental health crisis, including the projected |
---|
61 | 61 | | percentage of incoming patients who will likely require long-term |
---|
62 | 62 | | mental health treatment in a facility; and |
---|
63 | 63 | | (4) current and anticipated resources, including |
---|
64 | 64 | | workforce needs, necessary to meet the demands described by |
---|
65 | 65 | | Subdivisions (1), (2), and (3) of this subsection. |
---|
66 | 66 | | (c) In designing and conducting the study, the commission |
---|
67 | 67 | | may collaborate with institutions of higher education in this state |
---|
68 | 68 | | that award medical degrees. |
---|
69 | 69 | | (d) Not later than September 1, 2024, the commission shall |
---|
70 | 70 | | prepare and submit to the legislature a written report containing |
---|
71 | 71 | | the results of the study and any recommendations for legislative or |
---|
72 | 72 | | other action. |
---|
73 | 73 | | SECTION 2. This Act expires September 1, 2025. |
---|
74 | 74 | | SECTION 3. This Act takes effect immediately if it receives |
---|
75 | 75 | | a vote of two-thirds of all the members elected to each house, as |
---|
76 | 76 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
77 | 77 | | Act does not receive the vote necessary for immediate effect, this |
---|
78 | 78 | | Act takes effect September 1, 2023. |
---|
