44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a study regarding available beds at inpatient mental
77 health facilities providing acute psychiatric treatment.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. (a) In this section, "commission" means the
1010 Health and Human Services Commission.
1111 (b) The commission shall conduct a study regarding the
1212 availability of beds at inpatient mental health facilities in this
1313 state that provide acute inpatient psychiatric treatment. The
1414 study must evaluate:
1515 (1) the current number of psychiatric beds available
1616 at inpatient mental health facilities in this state that provide
1717 inpatient psychiatric treatment to individuals experiencing an
1818 acute mental health crisis, including a breakdown of beds available
1919 for patients:
2020 (A) committed to a facility for competency
2121 restoration services under Chapter 46B, Code of Criminal Procedure;
2222 (B) civilly committed to a facility under Chapter
2323 841, Health and Safety Code;
2424 (C) committed to a facility after having been
2525 found not guilty by reason of insanity under Chapter 46C, Code of
2626 Criminal Procedure;
2727 (D) voluntarily admitted to a facility;
2828 (E) 18 years of age or older;
2929 (F) younger than 18 years of age; and
3030 (G) receiving long-term mental health treatment
3131 in a facility;
3232 (2) the current number of patients admitted to an
3333 inpatient mental health facility in this state that provides
3434 inpatient psychiatric treatment to individuals experiencing an
3535 acute mental health crisis, including a breakdown of:
3636 (A) the number of patients committed to a
3737 facility for competency restoration services under Chapter 46B,
3838 Code of Criminal Procedure, including the number of individuals
3939 committed under an initial order of commitment or an order
4040 extending the initial restoration period;
4141 (B) the number of patients civilly committed to a
4242 facility under Chapter 841, Health and Safety Code;
4343 (C) the number of patients committed to a
4444 facility after having been found not guilty by reason of insanity
4545 under Chapter 46C, Code of Criminal Procedure;
4646 (D) the number of patients voluntarily admitted
4747 to a facility;
4848 (E) the number of patients 18 years of age or
4949 older;
5050 (F) the number of patients younger than 18 years
5151 of age;
5252 (G) the percentage of patients in this state who
5353 will likely require long-term mental health treatment in a
5454 facility; and
5555 (H) the number of patients who have been
5656 diagnosed with an intellectual or developmental disability;
5757 (3) the projected need over the next several years for
5858 additional psychiatric beds at inpatient mental health facilities
5959 that provide inpatient psychiatric treatment to individuals
6060 experiencing an acute mental health crisis, including the projected
6161 percentage of incoming patients who will likely require long-term
6262 mental health treatment in a facility; and
6363 (4) current and anticipated resources, including
6464 workforce needs, necessary to meet the demands described by
6565 Subdivisions (1), (2), and (3) of this subsection.
6666 (c) In designing and conducting the study, the commission
6767 may collaborate with institutions of higher education in this state
6868 that award medical degrees.
6969 (d) Not later than September 1, 2024, the commission shall
7070 prepare and submit to the legislature a written report containing
7171 the results of the study and any recommendations for legislative or
7272 other action.
7373 SECTION 2. This Act expires September 1, 2025.
7474 SECTION 3. This Act takes effect immediately if it receives
7575 a vote of two-thirds of all the members elected to each house, as
7676 provided by Section 39, Article III, Texas Constitution. If this
7777 Act does not receive the vote necessary for immediate effect, this
7878 Act takes effect September 1, 2023.
