66 AN ACT
77 relating to training for peace officers on investigating criminal
88 offenses involving elderly victims.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1701.253, Occupations Code, is amended
1111 by adding Subsection (q) to read as follows:
1212 (q) As part of the minimum curriculum requirements, the
1313 commission shall require an officer to complete the training
1414 program established under Section 1701.272. An officer shall
1515 complete the program not later than the last day of the first full
1616 continuing education training period that begins on or after the
1717 date the officer is licensed under this chapter unless the officer
1818 completes the program as part of the officer's basic training
1919 course.
2020 SECTION 2. Subchapter F, Chapter 1701, Occupations Code, is
2121 amended by adding Section 1701.272 to read as follows:
2222 Sec. 1701.272. TRAINING PROGRAM ON INVESTIGATING CRIMINAL
2323 OFFENSES INVOLVING ELDERLY VICTIMS. (a) The commission by rule
2424 shall require an officer to complete a one-time training program on
2525 investigating criminal offenses in which the victim or intended
2626 victim was 65 years of age or older at the time of the offense. The
2727 commission shall establish the training program required by this
2828 section.
2929 (b) The training program required by Subsection (a) must
3030 include:
3131 (1) procedures for reporting suspected abuse,
3232 neglect, or exploitation of an elderly person to the adult
3333 protective services division of the Department of Family and
3434 Protective Services; and
3535 (2) material on identifying potential decision-making
3636 capacity impairments affecting an elderly victim.
3737 SECTION 3. Section 1701.253(q), Occupations Code, as added
3838 by this Act, applies only to a person who submits an application for
3939 a peace officer license under Chapter 1701, Occupations Code, on or
4040 after January 1, 2024. A person who submits an application for a
4141 peace officer license under Chapter 1701, Occupations Code, before
4242 January 1, 2024, is governed by the law in effect immediately before
4343 that date, and the former law is continued in effect for that
4444 purpose.
4545 SECTION 4. Not later than January 1, 2024, the Texas
4646 Commission on Law Enforcement shall establish the training program
4747 required by Section 1701.272, Occupations Code, as added by this
4848 Act.
4949 SECTION 5. This Act takes effect September 1, 2023.
