44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the establishment of an advisory committee to study
77 suicide prevention and peer support programs in fire departments in
88 this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Commission" means the Texas Commission on Fire
1212 Protection.
1313 (2) "Fire department" has the meaning assigned by
1414 Section 419.021, Government Code.
1515 (3) "Fire fighter" has the meaning assigned by Section
1616 143.003, Local Government Code.
1717 SECTION 2. ADVISORY COMMITTEE. (a) The commission shall
1818 establish an advisory committee to study the need to implement
1919 suicide prevention and peer support programs in fire departments in
2020 this state. The committee is composed of the following members:
2121 (1) two fire fighters, appointed by the Texas State
2222 Association of Firefighters;
2323 (2) two fire chiefs, appointed by the Texas Fire
2424 Chiefs Association;
2525 (3) one person who is licensed to provide professional
2626 mental health services, as defined by Section 531.002, Health and
2727 Safety Code, appointed by the Texas Fire Chiefs Association;
2828 (4) one person who is licensed to provide professional
2929 mental health services as defined by Section 531.002, Health and
3030 Safety Code, appointed by the Texas State Association of
3131 Firefighters; and
3232 (5) the executive director of the commission.
3333 (b) The committee shall designate a member of the committee
3434 as chair of the committee.
3535 (c) The commission may adopt rules necessary to carry out
3636 the purpose and duties of the committee under this Act.
3737 (d) The commission shall provide administrative support and
3838 resources necessary for the committee to carry out the purpose and
3939 duties of the committee under this Act.
4040 (e) The committee may meet in person or by telephone
4141 conference, videoconference, or other electronic means.
4242 SECTION 3. REPORT. Not later than September 1, 2024, the
4343 advisory committee shall prepare and submit a report to the
4444 governor and the legislature. The report must:
4545 (1) provide an overview of suicide prevention and peer
4646 support groups in fire departments;
4747 (2) address possible licensing requirements and any
4848 confidentiality concerns; and
4949 (3) provide recommendations on:
5050 (A) the need for legislation to implement suicide
5151 prevention and peer support groups in fire departments;
5252 (B) whether to encourage local governments to
5353 develop local suicide prevention and peer support groups in fire
5454 departments; and
5555 (C) specific programs to be implemented in this
5656 state.
5757 SECTION 4. EXPIRATION DATE. The advisory committee created
5858 by this Act is abolished and this Act expires January 10, 2025.
5959 SECTION 5. EFFECTIVE DATE. This Act takes effect September
6060 1, 2023.
