| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter E, Chapter 228, |
|---|
| 11 | 11 | | Transportation Code, is amended to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL |
|---|
| 13 | 13 | | COLLECTION, AND [;] CONVERSION OF NONTOLLED STATE HIGHWAY |

| 14 | 14 | | SECTION 2. Subchapter E, Chapter 228, Transportation Code, |
|---|
| 15 | 15 | | is amended by adding Section 228.202 to read as follows: |

| 16 | 16 | | Sec. 228.202. TOLLS PROHIBITED ON PORTIONS OF STATE HIGHWAY |
|---|
| 17 | 17 | | 146 AND STATE HIGHWAY 99. The department may not charge a toll, |
|---|
| 18 | 18 | | either directly or indirectly through an agreement with another |
|---|
| 19 | 19 | | entity, on: |
|---|
| 20 | 20 | | (1) the portion of State Highway 146 that crosses the |
|---|
| 21 | 21 | | Houston Ship Channel; or |
|---|
| 22 | 22 | | (2) the portion of State Highway 99 between its |
|---|
| 23 | 23 | | intersection with State Highway 146 and its intersection with |
|---|
| 24 | 24 | | Interstate Highway 10. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
