88 AN ACT
99 relating to the bilingual education allotment under the public
1010 school finance system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 29.054, Education Code, is amended by
1313 adding Subsection (e) to read as follows:
1414 (e) Notwithstanding Section 29.066(c), the agency may
1515 require, for purposes of implementing Section 48.105, a school
1616 district that is granted an exception under this section to:
1717 (1) include in the district's Public Education
1818 Information Management System (PEIMS) report additional
1919 information specified by the agency and relating to the alternative
2020 language education methods used by the district; and
2121 (2) classify the alternative language education
2222 method used by the district under the Public Education Information
2323 Management System (PEIMS) report as specified by the agency.
2424 SECTION 2. Section 48.105, Education Code, is amended by
2525 adding Subsections (a-1) and (a-2) and amending Subsection (b) to
2626 read as follows:
2727 (a-1) The agency shall review school districts that offer
2828 alternative language methods approved by the agency under Section
2929 29.054(d) and approve districts to receive the allotment under
3030 Subsection (a-2) for that biennium in a manner that provides not
3131 more than $10 million total under the allotment to school districts
3232 in each biennium. In approving school districts to receive the
3333 allotment under this subsection, the agency shall, to the extent
3434 possible, approve eligible school districts from a cross section of
3535 this state.
3636 (a-2) For each student in average daily attendance in an
3737 alternative language method approved by the agency under Section
3838 29.054(d), and offered by a school district approved to receive the
3939 allotment under Subsection (a-1), the district is entitled to an
4040 annual allotment equal to the basic allotment multiplied by:
4141 (1) 0.15 for an emergent bilingual student, as defined
4242 by Section 29.052, if the student is in an alternative language
4343 method using a dual language immersion/one-way or two-way program
4444 model; and
4545 (2) 0.05 for a student not described by Subdivision
4646 (1), if the student is in an alternative language method using a
4747 dual language immersion/one-way or two-way program model.
4848 (b) At least 55 percent of the funds allocated under this
4949 section must be used in providing bilingual education or special
5050 language programs under Subchapter B, Chapter 29. A district's
5151 bilingual education or special language allocation may be used only
5252 for program and student evaluation, instructional materials and
5353 equipment, staff development, supplemental staff expenses, teacher
5454 salaries [salary supplements for teachers], incremental costs
5555 associated with providing smaller class sizes, and other supplies
5656 required for quality instruction.
5757 SECTION 3. This Act takes effect September 1, 2023.
