99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the provision of and professional liability insurance
1212 coverage for gender transitioning or gender reassignment medical
1313 procedures and treatments for certain children.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Chapter 161, Health and Safety Code, is amended
1616 by adding Subchapter X to read as follows:
1717 SUBCHAPTER X. GENDER TRANSITIONING AND GENDER REASSIGNMENT
1818 PROCEDURES AND TREATMENTS FOR CERTAIN CHILDREN
1919 Sec. 161.701. DEFINITIONS. In this subchapter:
2020 (1) "Child" means an individual who is younger than 18
2121 years of age.
2222 (2) "Health care provider" means a person other than a
2323 physician who is licensed, certified, or otherwise authorized by
2424 this state's laws to provide or render health care or to dispense or
2525 prescribe a prescription drug in the ordinary course of business or
2626 practice of a profession.
2727 (3) "Physician" means a person licensed to practice
2828 medicine in this state.
2929 Sec. 161.702. PROHIBITED PROVISION OF GENDER TRANSITIONING
3030 OR GENDER REASSIGNMENT PROCEDURES AND TREATMENTS TO CERTAIN
3131 CHILDREN. For the purpose of transitioning a child's biological
3232 sex as determined by the sex organs, chromosomes, and endogenous
3333 profiles of the child or affirming the child's perception of the
3434 child's sex if that perception is inconsistent with the child's
3535 biological sex, a physician or health care provider may not:
3636 (1) perform a surgery that sterilizes the child,
3737 including:
3838 (A) castration;
3939 (B) vasectomy;
4040 (C) hysterectomy;
4141 (D) oophorectomy;
4242 (E) metoidioplasty;
4343 (F) orchiectomy;
4444 (G) penectomy;
4545 (H) phalloplasty; and
4646 (I) vaginoplasty;
4747 (2) perform a mastectomy;
4848 (3) prescribe, administer, or supply any of the
4949 following medications that induce transient or permanent
5050 infertility:
5151 (A) puberty-blocking medication to stop or delay
5252 normal puberty;
5353 (B) supraphysiologic doses of testosterone to
5454 females; or
5555 (C) supraphysiologic doses of estrogen to males;
5656 or
5757 (4) remove any otherwise healthy or non-diseased body
5858 part or tissue.
5959 Sec. 161.703. EXCEPTIONS. Section 161.702 does not apply
6060 to the provision by a physician or health care provider, with the
6161 consent of the child's parent or legal guardian, of appropriate and
6262 medically necessary gender transitioning or gender reassignment
6363 procedures or treatments to a child who:
6464 (1) is born with a medically verifiable genetic
6565 disorder of sex development, including:
6666 (A) 46,XX chromosomes with virilization;
6767 (B) 46,XY chromosomes with undervirilization; or
6868 (C) both ovarian and testicular tissue; or
6969 (2) does not have the normal sex chromosome structure
7070 for male or female as determined by a physician through genetic
7171 testing.
7272 Sec. 161.704. DISCIPLINARY ACTION. The Texas Medical Board
7373 or another state regulatory agency with jurisdiction over a health
7474 care provider subject to Section 161.702 shall revoke the license,
7575 certification, or authorization of a physician or health care
7676 provider who the board or agency determines has violated that
7777 section.
7878 SECTION 2. Subchapter F, Chapter 1901, Insurance Code, is
7979 amended by adding Section 1901.256 to read as follows:
8080 Sec. 1901.256. PROHIBITED COVERAGE FOR PROVISION OF CERTAIN
8181 GENDER-RELATED PROCEDURES AND TREATMENTS TO CERTAIN CHILDREN. A
8282 professional liability insurance policy issued to a physician or
8383 health care provider may not include coverage for damages assessed
8484 against the physician or health care provider who provides to a
8585 child gender transitioning or gender reassignment procedures or
8686 treatments that are prohibited by Section 161.702, Health and
8787 Safety Code.
8888 SECTION 3. Section 1901.256, Insurance Code, as added by
8989 this Act, applies only to a medical professional liability
9090 insurance policy that is delivered, issued for delivery, or renewed
9191 on or after the effective date of this Act. An insurance policy
9292 that is delivered, issued for delivery, or renewed before the
9393 effective date of this Act is governed by the law in effect
9494 immediately before the effective date of this Act, and that law is
9595 continued in effect for that purpose.
9696 SECTION 4. This Act takes effect immediately if it receives
9797 a vote of two-thirds of all the members elected to each house, as
9898 provided by Section 39, Article III, Texas Constitution. If this
9999 Act does not receive the vote necessary for immediate effect, this
100100 Act takes effect September 1, 2023.
