| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 444, Government Code, is amended by |
|---|
| 9 | 9 | | adding Subchapter CC to read as follows: |
|---|
| 10 | 10 | | SUBCHAPTER CC. CULTURAL ADVANCEMENT FUND PROGRAM |
|---|
| 11 | 11 | | Sec.444.033. DEFINITIONS. In this subchapter: |
|---|
| 12 | 12 | | (1) "Commission" means the Texas Commission on the |
|---|
| 13 | 13 | | Arts. |
|---|
| 14 | 14 | | (2) "Cultural advancement" means any efforts that |
|---|
| 15 | 15 | | promote and support the sustainability of any culture in the State |
|---|
| 16 | 16 | | of Texas, including a culture's art, dance, music, or history. |
|---|
| 17 | 17 | | (a) For purposes of this section, "culture" means |
|---|
| 18 | 18 | | any nationality, racial, or ethnic group. |
|---|
| 19 | 19 | | (3) "Fund" means the cultural advancement fund created |
|---|
| 20 | 20 | | under Section 444.034. |
|---|
| 21 | 21 | | Sec. 444.034. CULTURAL ADVANCEMENT FUND. (a) The |
|---|
| 22 | 22 | | commission shall establish and administer the Cultural Advancement |
|---|
| 23 | 23 | | Fund as a dedicated account in the general revenue fund. |
|---|
| 24 | 24 | | (b) The following amounts shall be deposited in the fund: |
|---|
| 25 | 25 | | (1) any money appropriated by the legislature for |
|---|
| 26 | 26 | | the fund for purposes of this chapter; |
|---|
| 27 | 27 | | (2) interest earned on the investment of money in |
|---|
| 28 | 28 | | the fund; and |
|---|
| 29 | 29 | | (3) gifts, grants, and donations received for the |
|---|
| 30 | 30 | | fund. |
|---|
| 31 | 31 | | Sec. 444.035. GRANT PROGRAM. (a) The commission shall |
|---|
| 32 | 32 | | establish and administer the Cultural Advancement Fund grant |
|---|
| 33 | 33 | | program to benefit cultural centers, nonprofit corporations |
|---|
| 34 | 34 | | defined by section 22.001, Business Organizations Code, art venues, |
|---|
| 35 | 35 | | museums, or other entities that spur economic development through |
|---|
| 36 | 36 | | cultural advancement. |
|---|
| 37 | 37 | | (b) To be eligible to receive a grant under the grant |
|---|
| 38 | 38 | | program, an applicant must: |
|---|
| 39 | 39 | | (1) apply in a manner prescribed by commission rule; |
|---|
| 40 | 40 | | (2) be in good standing under the laws of this state; |
|---|
| 41 | 41 | | and |
|---|
| 42 | 42 | | (3) have a legitimate need for the grant. |
|---|
| 43 | 43 | | Sec.444.036. USES OF GRANT. A grant recipient may use the |
|---|
| 44 | 44 | | grant received under this subchapter for any expense needed to |
|---|
| 45 | 45 | | promote cultural advancement, including costs related to payroll, |
|---|
| 46 | 46 | | programming, remodeling, and renovating facilities. |
|---|
| 47 | 47 | | Sec.444.037. RULES. The commission shall adopt rules |
|---|
| 48 | 48 | | necessary to implement this subchapter. |
|---|
| 49 | 49 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 50 | 50 | | of this Act, and not later than September 1, 2024, the Commission on |
|---|
| 51 | 51 | | the Arts shall adopt rules necessary to implement Subchapter CC, |
|---|
| 52 | 52 | | Chapter 444, Government Code, as added by this Act. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect September 1, 2023. |
