44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the notice given to purchasers of property within
77 certain water districts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 49.452, Water Code, is amended by
1010 amending subsection (a) to read as follows:
1111 (a) (1) Any person who proposes to sell or convey real
1212 property located in a district as defined by this subsection must
1313 give to the purchaser the written notices as provided in this
1414 section.
1515 (2) For the purposes of this section, "district" means
1616 a district that:
1717 (A) operates pursuant to Chapter 375, Local
1818 Government Code; or
1919 (B) is created under this title or by a special
2020 Act of the legislature,
2121 (i) that is providing or proposing to
2222 provide, as the district's principal function, water, sanitary
2323 sewer, drainage, and flood control or protection facilities or
2424 services, or any of these facilities or services that have been
2525 financed or are proposed to be financed with bonds of the district
2626 payable in whole or part from taxes of the district, or by
2727 imposition of a standby fee, if any, to household or commercial
2828 users, other than agricultural, irrigation, or industrial users,
2929 and
3030 (ii) [which district] includes less
3131 than all the territory in at least one county and which, if located
3232 within the corporate area of a city, includes less than 75 percent
3333 of the incorporated area of the city or which is located outside the
3434 corporate area of a city in whole or in substantial part [, must
3535 first give to the purchaser the written notice provided in Section
3636 49.4525 this section].
3737 (3)(2) The provisions of this section shall not be
3838 applicable to:
3939 (A) transfers of title under any type of lien
4040 foreclosure;
4141 (B) transfers of title by deed in cancellation of
4242 indebtedness secured by a lien upon the property conveyed;
4343 (C) transfers of title by reason of a will or
4444 probate proceedings; [or]
4545 (D) transfers of title to a governmental entity;
4646 or
4747 (E) transfers of title for the purpose of
4848 qualifying a director.
4949 SECTION 2. Subchapter M, Chapter 49, Water Code, is amended
5050 by adding Section 49.4525 to read as follows:
5151 Sec. 49.4525. FORM OF NOTICE. (a) The caption at the top of
5252 the prescribed notice shall be printed in bold, capitalized letters
5353 in a font that is 24 point or larger and shall read: "NOTICE TO
5454 PURCHASER OF SPECIAL TAXING OR ASSESSMENT DISTRICT."
5555 (b) The prescribed notice shall include the following
5656 statements as applicable to the district, as determined by the
5757 district. Statements not applicable to the district shall be
5858 omitted or edited for accuracy, as determined by the district.
5959 (i) "The real property that you are about to
6060 purchase is located in the __________ District and may be subject to
6161 district taxes or assessments."
6262 (ii) "The district may, subject to voter
6363 approval, levy taxes and issue bonds and levy an unlimited rate of
6464 tax in payment of such bonds."
6565 (iii) (A) "The current rate of the district
6666 property tax is $__________ on each $100 of assessed valuation.";
6767 or
6868 (B) "The district has not yet levied taxes,
6969 but the projected rate of the district property tax is $__________
7070 on each $100 of assessed valuation."
7171 (iv) "The district may impose assessments and
7272 issue bonds and impose an assessment in payment of such bonds."
7373 (v) (A) "The rate of the district assessment
7474 is $___________ on each $100 of assessed valuation."; or
7575 (B) "The amount of the district assessment
7676 on the real property that you are about to purchase is
7777 $__________."; or
7878 (C) "The district has not yet imposed an
7979 assessment, but the projected [rate] [amount] of assessment is
8080 $__________."
8181 (vi) "The total amounts of bonds payable in whole
8282 or in part from [property taxes] [assessments], [excluding
8383 [refunding bonds that are separately approved by the voters] and
8484 [any bonds or any portion of bonds issued that are payable solely
8585 from revenues received or expected to be received under a contract
8686 with a governmental entity]], approved by the voters are:
8787 (A) $__________ for water, sewer, and
8888 drainage facilities;
8989 (B) $__________ for road facilities;
9090 (C) $___________ for parks and recreational
9191 facilities; and
9292 (D) $__________ for __________
9393 facilities."
9494 (vii) "The aggregate initial principal amounts
9595 of all such bonds issued are:
9696 (A) $__________ for water, sewer, and
9797 drainage facilities;
9898 (B) $__________ for road facilities;
9999 (C) $___________ for parks and recreational
100100 facilities; and
101101 (D) $__________ for __________
102102 facilities."
103103 (ix) "The district sought and obtained approval
104104 of the Texas Commission on Environmental Quality to adopt and
105105 impose a standby fee. The amount of the standby fee is $__________.
106106 An unpaid standby fee is a personal obligation of the person that
107107 owned the property at the time of imposition and is secured by a
108108 lien on the property. Any person may request a certificate from the
109109 district stating the amount, if any, of unpaid standby fees on a
110110 tract of property in the district."
111111 (x) (A) "The district is located in whole or
112112 in part in the extraterritorial jurisdiction of the City of
113113 __________. Texas law governs the ability of a municipality to
114114 annex property in the extraterritorial jurisdiction and whether a
115115 district that is annexed is dissolved."; or
116116 (B) "The district is located in whole or in
117117 part within the corporate boundaries of the City of __________. The
118118 city and the district overlap, but may not provide duplicate
119119 services or improvements. Property located in the city and the
120120 district is subject to taxation by the city and the district."
121121 (xi) "The district has entered into a strategic
122122 partnership agreement with the City of ___________. This agreement
123123 may address the timeframe, process, and procedures for the
124124 municipal annexation of the area of the district."
125125 (xii) "The purpose of the district is to provide
126126 [[water,] [sewer,] [drainage,] [flood control,] [fire-fighting,]
127127 [road,] [park and recreational,] or [____________ ]] facilities and
128128 services. The cost of district facilities is not included in the
129129 purchase price of your property."
130130 (xiii) "PURCHASER IS ADVISED THAT THE
131131 INFORMATION SHOWN ON THIS FORM IS SUBJECT TO CHANGE BY THE DISTRICT
132132 AT ANY TIME. THE DISTRICT ANNUALLY ESTABLISHES TAX RATES.
133133 PURCHASER IS ADVISED TO CONTACT THE DISTRICT TO DETERMINE THE
134134 STATUS OF ANY CURRENT OR PROPOSED CHANGES TO THE INFORMATION SHOWN
135135 ON THIS FORM."
136136 "The undersigned purchaser hereby acknowledges
137137 receipt of the foregoing notice at or prior to execution of a
138138 binding contract for the purchase of the real property or at closing
139139 of purchase of the real property."
140140 (d) The notice shall be dated and executed by the seller and
141141 the purchaser.
142142 (e) If the law is amended and causes inaccuracies in the
143143 content of the notice, the district shall revise the content of the
144144 notice to accurately reflect current law.
145145 SECTION 3. Section 49.453, Water Code, is amended to add
146146 subsection (e) to read as follows:
147147 (e) A district required by Section 26.18, Tax Code, to
148148 maintain an Internet website or have access to a generally
149149 accessible Internet website for the purposes of that section, shall
150150 post or cause to be posted on the Internet the district's form of
151151 notice to purchasers under Section 49.4525.
152152 SECTION 4. Subsection 49.455(c), Water Code, is amended to
153153 read as follows:
154154 (c) The information form [and map or plat required by this
155155 section] shall be signed by a majority of the members of the board
156156 and by each such officer affirmed and acknowledged before it is
157157 filed with the county clerk, and each amendment made to an
158158 information form [or map] shall also be signed by the members of the
159159 board and by each such officer affirmed and acknowledged before it
160160 is filed with the county clerk.
161161 SECTION 5. (1) Subsections 49.452(b),(c),(d), and (e) are
162162 repealed.
163163 (2) Subsections 49.455(f) and (h) are repealed.
164164 SECTION 6. This Act takes effect immediately if it receives
165165 a vote of two-thirds of all the members elected to each house, as
166166 provided by Section 39, Article III, Texas Constitution. If this
167167 Act does not receive the vote necessary for immediate effect, this
168168 Act takes effect September 1, 2023.
