55 AN ACT
66 relating to the requirements and procedures for use of the flood
77 infrastructure fund.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 15.535, Water Code, is amended by adding
1010 Subsection (d) to read as follows:
1111 (d) An eligible political subdivision may demonstrate
1212 compliance with the requirements of subsection (a)(1), (2), and (3)
1313 by providing written notice of the application, along with a copy of
1414 the application, to all potentially affected political
1515 subdivisions in the area. The notice must be provided at least 30
1616 days before submittal of the final application to the board and
1717 include instructions for submittal of comments on the application.
1818 All comments received in accordance with this subsection must be
1919 included in the final application submitted to the board.
2020 SECTION 2. Section 15.536, Water Code, is amended to read as
2121 follows:
2222 Sec. 15.536. APPROVAL OF APPLICATIONS. On review and
2323 recommendation by the executive administrator, the board may
2424 approve an application only if the board finds that:
2525 (1) the application and the assistance applied for
2626 meet the requirements of this subchapter and board rules;
2727 (2) the application demonstrates compliance with this
2828 subchapter [a sufficient level of cooperation among eligible
2929 political subdivisions and includes all of the eligible political
3030 subdivisions substantially affected by the flood project]; and
3131 (3) the taxes or other revenue, or both the taxes and
3232 other revenue, pledged by the applicant will be sufficient to meet
3333 all the obligations assumed by the eligible political subdivision.
3434 SECTION 3. Section 15.537, Water Code, is amended to read as
3535 follows:
3636 Sec. 15.537. RULES. (a) The board shall adopt rules
3737 necessary to carry out this subchapter, including rules:
3838 (1) that establish procedures for an application for
3939 and for the award of financial assistance;
4040 (2) for the investment of money; and
4141 (3) for the administration of the infrastructure fund.
4242 (b) The rules may not include a requirement to provide a
4343 written agreement among political subdivisions or a benefit cost
4444 analysis as a condition for approval of an application.
4545 SECTION 4. The changes made by this Act apply only to an
4646 application submitted on or after the effective date of this Act.
4747 SECTION 5. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2023.
