| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 25, Education Code, is |
|---|
| 11 | 11 | | amended by adding Sections 25.0813 and 25.0814 to read as follows: |
|---|
| 12 | 12 | | Sec. 25.0813. SCHOOL CAMPUS DESIGNATED AS POLLING PLACE. |
|---|
| 13 | 13 | | If a public school campus is selected for use as a polling place |
|---|
| 14 | 14 | | under Section 43.031, Election Code, the school district or |
|---|
| 15 | 15 | | open-enrollment charter school shall designate the day the campus |
|---|
| 16 | 16 | | serves as a polling place as a staff development day. |
|---|
| 17 | 17 | | Sec. 25.0814. INSTRUCTIONAL TIME WAIVERS FOR CAMPUSES |
|---|
| 18 | 18 | | DESIGNATED AS POLLING PLACES. (a) The commissioner shall provide a |
|---|
| 19 | 19 | | waiver allowing the minutes of instructional time required under |
|---|
| 20 | 20 | | Section 25.081(a) for a school district or open-enrollment charter |
|---|
| 21 | 21 | | school campus to be reduced by the number of minutes the district or |
|---|
| 22 | 22 | | school is required to suspend instruction in compliance with |
|---|
| 23 | 23 | | Section 25.0813. |
|---|
| 24 | 24 | | (b) A waiver under this section may not result in an |
|---|
| 25 | 25 | | inadequate number of minutes of instructional time for students. |
|---|
| 26 | 26 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 27 | 27 | | school year. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2023. |
