55 AN ACT
66 relating to test gathering requirements for certain wastewater
77 treatment facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 26, Water Code, is amended by adding
1010 Section 26.054 to read as follows:
1111 Sec. 26.054. WASTEWATER DATA GATHERING REQUIREMENTS (a)
1212 The commission shall require testing through an accredited or
1313 certified environmental testing laboratory for the compounds
1414 listed in subsection (f).For every wastewater treatment facility
1515 required to be tested under this section, the following shall be
1616 tested:
1717 (1) Wastewater influent before entering a facility for
1818 treatment, including influent derived from industrial, cooling,
1919 leachate, return flow, surface runoff, and urban runoff sources;
2020 (2) Grit and debris separated before taken to a
2121 landfill;
2222 (3) Raw sewage;
2323 (4) Pre-treated sewage;
2424 (5) Biosolids;
2525 (6) Sludge produced in wastewater treatment;
2626 (7) Effluent departing wastewater treatment plant;
2727 (8) Groundwater;
2828 (9) Surface water;
2929 (10) Water upon entering drinking water treatment
3030 plant;
3131 (11) Treated water departing drinking water treatment
3232 plant; and
3333 (12) Public drinking water.
3434 (b) The commission shall select testing locations that are
3535 reasonably representative of the typical water systems in the
3636 community and shall avoid non-representative locations. The
3737 commission may conduct more than one test in a particular category
3838 to ensure reasonably representative results.
3939 (c) Testing as described in Subsection (a) shall occur at
4040 every wastewater treatment plant within ten (10) miles of every
4141 city with a population of at least 250,000.
4242 (d) In addition to the testing shall occur in no fewer than:
4343 (1) ten (10) wastewater treatment plants within ten
4444 (10) miles of cities with populations between 100,000 and 250,000;
4545 (2) ten (10) wastewater treatment plants within ten
4646 (10) miles of cities with populations between 25,000 and 100,000;
4747 and
4848 (3) ten (10) wastewater treatment plants within ten
4949 (10) miles of cities with populations below 25,000.
5050 (e) The commission shall require testing once each calendar
5151 quarter.
5252 (f) The commission shall require testing for each of the
5353 following urinary metabolites in the form of glucronytes:
5454 (1) Benzophenone;
5555 (2) Bisphenol A;
5656 (3) Estrone;
5757 (4) Ethynylestradiol;
5858 (5) Musk Ketone;
5959 (6) Pregnanediol;
6060 (7) Testosterone;
6161 (8) Tonalide (AHTN);
6262 (9) 11β-[p-(Dimethylamino)phenyl]-17α-(1-propynyl)es
6363 tra-4,9-dien-17β-ol-3-one;and
6464 (10) any other organic substances as deemed necessary
6565 by the commission.
6666 (g) In addition to records required to be kept in the normal
6767 course of water testing, the commission shall keep detailed records
6868 of all testing conducted under this section, including:
6969 (1) the date and location of sampling;
7070 (2) date of testing; and
7171 (3) the results of testing in nanograms per liter.
7272 (h) The commission shall post quarterly on its Internet
7373 website all reports, test results, and records required under this
7474 section.
7575 SECTION 2. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2023.
