55 AN ACT
66 relating to the abolition of the Texas Windstorm Insurance
77 Association and coverage for windstorm by certain insurers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 10, Subtitle G, is amended by adding
1010 Chapter 2210A, Insurance Code, to read as follows:
1111 CHAPTER 2210A. TEXAS WINDSTORM INSURANCE
1212 Sec. 2210A.001. WINDSTORM COVERAGE REQUIRED. (a) This
1313 chapter applies to all property insurers authorized to engage in
1414 the business of property and casualty insurance in this state.
1515 (b) As a condition of the insurer's authority to engage in
1616 the business of insurance in this state, each insurer, described by
1717 Subsection (a), must include coverage for windstorm and hail in
1818 each policy written for property located within:
1919 (A) Aransas County;
2020 (B) Brazoria County;
2121 (C) Calhoun County;
2222 (D) Cameron County;
2323 (E) Chambers County;
2424 (F) Galveston County;
2525 (G) Jefferson County;
2626 (H) Kenedy County;
2727 (I) Kleberg County;
2828 (J) Matagorda County;
2929 (K) Nueces County;
3030 (L) Refugio County;
3131 (M) San Patricio County; or
3232 (N) Willacy County.
3333 (c) Coverage provided under Subsection (b) must be provided
3434 at no additional cost to the insured. Costs incurred by insurers
3535 under this section shall not be recouped through a premium
3636 surcharge.
3737 SECTION 2. Chapter 2210, Insurance Code, is repealed.
3838 SECTION 3. (a) The Texas Windstorm Insurance Association
3939 is abolished but continues in existence until September 1, 2024,
4040 for purpose of satisfying or transferring obligations according to
4141 Subsection (b).
4242 (b) The Texas Windstorm Insurance Association shall, no
4343 later than September 1, 2024, liquidate all assets and utilize the
4444 funds to satisfy obligations.
4545 (c) Any obligations not satisfied by Subsection (b) shall be
4646 paid from pro rata member assessments. The proportion of each
4747 member's assessment shall be determined in the manner used to
4848 determine each insurer's participation in the association for the
4949 year under Section 2210.052, Insurance Code, as that section
5050 existed before the effective date of this Act.
5151 SECTION 4. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect on September 1, 2023.
