55 AN ACT
66 relating to infrastructure planning and lot frontages in the
77 unincorporated area of certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Subchapter E, Chapter 232, Local
1010 Government Code, is amended to read as follows:
1111 SUBCHAPTER E. INFRASTRUCTURE PLANNING PROVISIONS [IN
1212 CERTAIN URBAN COUNTIES]
1313 SECTION 2. Section 232.101, Local Government Code, is
1414 amended by adding Subsection (a-1) to read as follows:
1515 (a-1) This subsection applies only to a county that has a
1616 population of more than 370,000 and contains more than ten
1717 municipalities with a population of less than 2,000. After
1818 complying with the procedures described by Subsection (a), the
1919 commissioners court of a county may adopt additional rules
2020 governing plats and subdivisions of land within the unincorporated
2121 area of the county. The rules adopted under this subsection may
2222 include only:
2323 (1) lot frontage minimums;
2424 (2) road width requirements based on the lot density
2525 of a development; and
2626 (3) ingress and egress requirements based on the lot
2727 density of a development.
2828 SECTION 3. Section 232.103, Local Government Code, is
2929 amended to read as follows:
3030 Sec. 232.103. LOT FRONTAGES. (a) By an order adopted and
3131 entered in the minutes of the commissioners court and after a notice
3232 is published in a newspaper of general circulation in the county,
3333 the commissioners court may adopt reasonable standards for minimum
3434 lot frontages on existing county roads and establish reasonable
3535 standards for the lot frontages in relation to curves in the road.
3636 (b) This subsection applies only to a county that has a
3737 population of more than 370,000 and contains more than ten
3838 municipalities with a population of less than 2,000. After
3939 complying with the procedures described by Subsection (a), the
4040 commissioners court of a county may adopt reasonable standards for
4141 minimum lot frontages on planned roads within a subdivision for
4242 which a plat is required under this chapter and establish
4343 reasonable standards for the lot frontages in relation to curves in
4444 the road.
4545 SECTION 4. This Act takes effect September 1, 2023.
