| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Subchapter E, Chapter 232, Local |
|---|
| 10 | 10 | | Government Code, is amended to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER E. INFRASTRUCTURE PLANNING PROVISIONS [IN |
|---|
| 12 | 12 | | CERTAIN URBAN COUNTIES] |
|---|
| 13 | 13 | | SECTION 2. Section 232.101, Local Government Code, is |
|---|
| 14 | 14 | | amended by adding Subsection (a-1) to read as follows: |
|---|
| 15 | 15 | | (a-1) This subsection applies only to a county that has a |
|---|
| 16 | 16 | | population of more than 370,000 and contains more than ten |
|---|
| 17 | 17 | | municipalities with a population of less than 2,000. After |
|---|
| 18 | 18 | | complying with the procedures described by Subsection (a), the |
|---|
| 19 | 19 | | commissioners court of a county may adopt additional rules |
|---|
| 20 | 20 | | governing plats and subdivisions of land within the unincorporated |
|---|
| 21 | 21 | | area of the county. The rules adopted under this subsection may |
|---|
| 22 | 22 | | include only: |
|---|
| 23 | 23 | | (1) lot frontage minimums; |
|---|
| 24 | 24 | | (2) road width requirements based on the lot density |
|---|
| 25 | 25 | | of a development; and |
|---|
| 26 | 26 | | (3) ingress and egress requirements based on the lot |
|---|
| 27 | 27 | | density of a development. |
|---|
| 28 | 28 | | SECTION 3. Section 232.103, Local Government Code, is |
|---|
| 29 | 29 | | amended to read as follows: |
|---|
| 30 | 30 | | Sec. 232.103. LOT FRONTAGES. (a) By an order adopted and |
|---|
| 31 | 31 | | entered in the minutes of the commissioners court and after a notice |
|---|
| 32 | 32 | | is published in a newspaper of general circulation in the county, |
|---|
| 33 | 33 | | the commissioners court may adopt reasonable standards for minimum |
|---|
| 34 | 34 | | lot frontages on existing county roads and establish reasonable |
|---|
| 35 | 35 | | standards for the lot frontages in relation to curves in the road. |
|---|
| 36 | 36 | | (b) This subsection applies only to a county that has a |
|---|
| 37 | 37 | | population of more than 370,000 and contains more than ten |
|---|
| 38 | 38 | | municipalities with a population of less than 2,000. After |
|---|
| 39 | 39 | | complying with the procedures described by Subsection (a), the |
|---|
| 40 | 40 | | commissioners court of a county may adopt reasonable standards for |
|---|
| 41 | 41 | | minimum lot frontages on planned roads within a subdivision for |
|---|
| 42 | 42 | | which a plat is required under this chapter and establish |
|---|
| 43 | 43 | | reasonable standards for the lot frontages in relation to curves in |
|---|
| 44 | 44 | | the road. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2023. |
