55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reduction of methane gas flaring on land dedicated
88 to the permanent university fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 66, Education Code, is
1111 amended by adding Section 66.455 to read as follows:
1212 Sec. 66.455. METHANE FLARING REDUCTION PLANS. (a) The
1313 board of regents of The University of Texas System shall adopt a
1414 formal policy goal to eliminate routine methane flaring on
1515 university lands by 2027.
1616 (b) Under each lease issued, modified, or renewed under this
1717 subchapter relating to oil or gas, the lessee shall submit to the
1818 board of regents of The University of Texas System a plan to end
1919 routine methane flaring in accordance with the policy goal adopted
2020 under Subsection (a). The plan must:
2121 (1) include provisions that prohibit routine methane
2222 flaring;
2323 (2) for all new and existing sources, require
2424 operators to adhere to the United States Environmental Protection
2525 Agency's new source performance standards for methane emissions;
2626 and
2727 (3) require the lessee to implement quarterly
2828 inspections and maintenance for the detection of malfunctioning and
2929 unlit flares using leak detection equipment, such as optical gas
3030 imaging cameras, and for the repair of those flares.
3131 (c) The board of regents of The University of Texas System
3232 shall review and approve or reject each plan submitted under
3333 Subsection (b) according to procedures adopted by the board. The
3434 University of Texas Bureau of Economic Geology shall assist the
3535 board and lessees in matters relating to the plans.
3636 (d) In adopting procedures to implement this section, the
3737 board of regents of The University of Texas System may apply to new
3838 facilities and existing facilities that have been modified after
3939 initial construction more stringent standards than the standards
4040 the board applies to other facilities.
4141 SECTION 2. Not later than June 1, 2024, the board of regents
4242 of The University of Texas System shall adopt procedures
4343 implementing Section 66.455, Education Code, as added by this Act.
4444 SECTION 3. This Act takes effect September 1, 2023.
