99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 7994A to read as follows:
1212 CHAPTER 7994A. OPEN R FRESH WATER SUPPLY DISTRICT OF CALDWELL
1313 COUNTY
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 7994A.0101. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Open R Fresh Water Supply
1919 District of Caldwell County.
2020 Sec. 7994A.0102. NATURE OF DISTRICT. The district is a
2121 municipal utility district created under Section 59, Article XVI,
2222 Texas Constitution.
2323 Sec. 7994A.0103. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
2424 (a) The district is created to serve a public purpose and benefit.
2525 (b) The district is created to accomplish the purposes of:
2626 (1) a municipal utility district as provided by
2727 general law and Section 59, Article XVI, Texas Constitution; and
2828 (2) Section 52, Article III, Texas Constitution, that
2929 relate to the construction, acquisition, improvement, operation,
3030 or maintenance of macadamized, graveled, or paved roads, or
3131 improvements, including storm drainage, in aid of those roads.
3232 Sec. 7994A.0104. DISTRICT TERRITORY. (a) The district is
3333 composed of the territory described by Section 2 of the Act enacting
3434 this chapter.
3535 (b) The boundaries and field notes contained in Section 2 of
3636 the Act enacting this chapter form a closure. A mistake made in the
3737 field notes or in copying the field notes in the legislative process
3838 does not affect the district's:
3939 (1) organization, existence, or validity;
4040 (2) right to issue any type of bond for the purposes
4141 for which the district is created or to pay the principal of and
4242 interest on a bond;
4343 (3) right to impose a tax; or
4444 (4) legality or operation.
4545 SUBCHAPTER B. POWERS AND DUTIES
4646 Sec. 7994A.0201. GENERAL POWERS AND DUTIES. The district
4747 has the powers and duties necessary to accomplish the purposes for
4848 which the district is created.
4949 Sec. 7994A.0202. MUNICIPAL UTILITY DISTRICT POWERS AND
5050 DUTIES. The district has the powers and duties provided by the
5151 general law of this state, including Chapters 49 and 54, Water Code,
5252 applicable to municipal utility districts created under Section 59,
5353 Article XVI, Texas Constitution.
5454 Sec. 7994A.0203. AUTHORITY FOR ROAD PROJECTS. Under
5555 Section 52, Article III, Texas Constitution, the district may
5656 design, acquire, construct, finance, issue bonds for, improve,
5757 operate, maintain, and convey to this state, a county, or a
5858 municipality for operation and maintenance macadamized, graveled,
5959 or paved roads, or improvements, including storm drainage, and
6060 landscaping, in aid of those roads.
6161 Sec. 7994A.0204. ROAD STANDARDS AND REQUIREMENTS. (a) A
6262 road project must meet all applicable construction standards,
6363 zoning and subdivision requirements, and regulations of each
6464 municipality in whose corporate limits or extraterritorial
6565 jurisdiction the road project is located.
6666 (b) If a road project is not located in the corporate limits
6767 or extraterritorial jurisdiction of a municipality, the road
6868 project must meet all applicable construction standards,
6969 subdivision requirements, and regulations of each county in which
7070 the road project is located.
7171 (c) If the state will maintain and operate the road, the
7272 Texas Transportation Commission must approve the plans and
7373 specifications of the road project.
7474 SUBCHAPTER C. GENERAL FINANCIAL PROVISIONS
7575 Sec. 7994A.0301. ELECTIONS REGARDING TAXES OR BONDS. (a)
7676 The district may issue, without an election, bonds and other
7777 obligations secured by:
7878 (1) revenue other than ad valorem taxes; or
7979 (2) contract payments described by Section
8080 7994A.0303.
8181 (b) The district must hold an election in the manner
8282 provided by Chapters 49 and 54, Water Code, to obtain voter approval
8383 before the district may impose an ad valorem tax or issue bonds
8484 payable from ad valorem taxes.
8585 (c) The district may not issue bonds payable from ad valorem
8686 taxes to finance a road project unless the issuance is approved by a
8787 vote of a two-thirds majority of the district voters voting at an
8888 election held for that purpose.
8989 Sec. 7994A.0302. OPERATION AND MAINTENANCE TAX. (a) If
9090 authorized at an election held under Section 7994A.0301, the
9191 district may impose an operation and maintenance tax on taxable
9292 property in the district in accordance with Section 49.107, Water
9393 Code.
9494 (b) The board shall determine the tax rate. The rate may not
9595 exceed the rate approved at the election.
9696 Sec. 7994A.0303. CONTRACT TAXES. (a) In accordance with
9797 Section 49.108, Water Code, the district may impose a tax other than
9898 an operation and maintenance tax and use the revenue derived from
9999 the tax to make payments under a contract after the provisions of
100100 the contract have been approved by a majority of the district voters
101101 voting at an election held for that purpose.
102102 (b) A contract approved by the district voters may contain a
103103 provision stating that the contract may be modified or amended by
104104 the board without further voter approval.
105105 SUBCHAPTER D. BONDS AND OTHER OBLIGATIONS
106106 Sec. 7994A.0401. AUTHORITY TO ISSUE BONDS AND OTHER
107107 OBLIGATIONS. The district may issue bonds or other obligations
108108 payable wholly or partly from ad valorem taxes, impact fees,
109109 revenue, contract payments, grants, or other district money, or any
110110 combination of those sources, to pay for any authorized district
111111 purpose.
112112 Sec. 7994A.0402. TAXES FOR BONDS. At the time the district
113113 issues bonds payable wholly or partly from ad valorem taxes, the
114114 board shall provide for the annual imposition of a continuing
115115 direct ad valorem tax, without limit as to rate or amount, while all
116116 or part of the bonds are outstanding as required and in the manner
117117 provided by Sections 54.601 and 54.602, Water Code.
118118 Sec. 7994A.0403. BONDS FOR ROAD PROJECTS. At the time of
119119 issuance, the total principal amount of bonds or other obligations
120120 issued or incurred to finance road projects and payable from ad
121121 valorem taxes may not exceed one-fourth of the assessed value of the
122122 real property in the district.
123123 SECTION 2. The Open R Fresh Water Supply District of
124124 Caldwell County includes all the territory contained in the
125125 following area:
126126 BEING a 10.00 acre tract of land situated in the William Morrison
127127 Survey, Abstract Number 187, Caldwell County, Texas, being all of
128128 tract of land described in the deed to Michael M. Reynolds, recorded
129129 in Volume 130, Page 887, Official Public Records of Caldwell
130130 County, Texas, said 10.00 acres being more particularly described
131131 as follows;
132132 COMMENCING at a found 3/8-inch iron rod with cap stamped "RPLS 454r
133133 for the northeast corner of a tract of land described in the deed to
134134 Jacob K. Hohertz recorded in Instrument Number 2015-004255,
135135 Official Public Records of Caldwell County, Texas;
136136 THENCE North 04 degrees 07 minutes 28 seconds West, a distance of
137137 303.33 feet to a set 5/8-inch iron rod with cap stamped "DUNAWAY
138138 ASSOC" for the POINT OF BEGINNING;
139139 THENCE North 10 degrees 55 minutes 01 second West, a distance of
140140 660.00 feet to a found 1/2-inch iron rod with cap stamped "UDG

142142 THENCE North 79 degrees 04 minutes 59 seconds East, a distance of

150150 10.00 acres or 435,600 square feet of land, more or less.

215215 east line of said Marshall G. Varner tract and with a south line of

289289 point from which a found broken concrete TXDOT monument bears North
290290 32 degrees 05 minutes 26 seconds East, a distance of 1.36 feet;
291291 THENCE South 12 degrees 38 minutes 33 seconds East, along the west
292292 right-of-way line of F.M. 2001, a distance of 15.80 feet to the
293293 POINT OF BEGINNING.
294294 CONTAINING a computed area of 1,278.22 acres or 55,679,090 square
295295 feet of land, more or less.
296296 SECTION 3. (a) All governmental and proprietary actions
297297 and proceedings of the Open R Fresh Water Supply District of
298298 Caldwell County taken before the effective date of this Act are
299299 validated, ratified, and confirmed in all respects as of the dates
300300 on which they occurred.
301301 (b) This section does not apply to any matter that on the
302302 effective date of this Act:
303303 (1) is involved in litigation if the litigation
304304 ultimately results in the matter being held invalid by a final court
305305 judgment; or
306306 (2) has been held invalid by a final court judgment.
307307 SECTION 4. (a) The legal notice of the intention to
308308 introduce this Act, setting forth the general substance of this
309309 Act, has been published as provided by law, and the notice and a
310310 copy of this Act have been furnished to all persons, agencies,
311311 officials, or entities to which they are required to be furnished
312312 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
313313 Government Code.
314314 (b) The governor, one of the required recipients, has
315315 submitted the notice and Act to the Texas Commission on
316316 Environmental Quality.
317317 (c) The Texas Commission on Environmental Quality has filed
318318 its recommendations relating to this Act with the governor, the
319319 lieutenant governor, and the speaker of the house of
320320 representatives within the required time.
321321 (d) All requirements of the constitution and laws of this
322322 state and the rules and procedures of the legislature with respect
323323 to the notice, introduction, and passage of this Act are fulfilled
324324 and accomplished.
325325 SECTION 5. (a) If this Act does not receive a two-thirds
326326 vote of all the members elected to each house, Subchapter B, Chapter
327327 7994A, Special District Local Laws Code, as added by Section 1 of
328328 this Act, is amended by adding Section 7994A.0205 to read as
329329 follows:
330330 Sec. 7994A.0205. NO EMINENT DOMAIN POWER. The district may
331331 not exercise the power of eminent domain.
332332 (b) This section is not intended to be an expression of a
333333 legislative interpretation of the requirements of Section 17(c),
334334 Article I, Texas Constitution.
335335 SECTION 6. This Act takes effect immediately if it receives
336336 a vote of two-thirds of all the members elected to each house, as
337337 provided by Section 39, Article III, Texas Constitution. If this
338338 Act does not receive the vote necessary for immediate effect, this
339339 Act takes effect September 1, 2023.
