66 relating to energy efficiency goals for electric utilities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 39.905, Utilities Code, is amended by
99 adding Subsection (a-1) to read as follows:
1010 (a-1) In addition to meeting the demand goals provided by
1111 Subsection (a), the commission by rule shall provide a method to
1212 establish an annual energy savings goal of one percent not later
1313 than the 2030 calendar year for each electric utility. The method
1414 must be based on the existing and expected usage of electricity
1515 delivered in a utility's service area that is required to pay the
1616 annual energy efficiency cost recovery fee. In adopting rules, the
1717 commission may provide for cost caps for the implementation of this
1818 subsection and provide good cause exceptions for a utility that is
1919 unable to meet the goal in a cost-effective manner.
2020 SECTION 2. The Public Utility Commission of Texas shall
2121 adopt rules to implement the changes made by this Act to Section
2222 39.905, Utilities Code, not later than December 31, 2023.
2323 SECTION 3. This Act takes effect September 1, 2023.
