1010 AN ACT
1111 relating to the creation of the Martindale Municipal Utility
1212 District No. 1 of Caldwell County, Texas; granting a limited power
1313 of eminent domain; providing authority to issue bonds; providing
1414 authority to impose assessments, fees, and taxes.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1717 Code, is amended by adding Chapter 7989A to read as follows:
1818 CHAPTER 7989A. MARTINDALE MUNICIPAL UTILITY DISTRICT NO. 1 OF
1919 CALDWELL COUNTY, TEXAS
2020 SUBCHAPTER A. GENERAL PROVISIONS
2121 Sec. 7989A.0101. DEFINITIONS. In this chapter:
2222 (1) "Board" means the district's board of directors.
2323 (2) "Commission" means the Texas Commission on
2424 Environmental Quality.
2525 (3) "Director" means a board member.
2626 (4) "District" means the Martindale Municipal Utility
2727 District No. 1 of Caldwell County, Texas.
2828 Sec. 7989A.0102. NATURE OF DISTRICT. The district is a
2929 municipal utility district created under Section 59, Article XVI,
3030 Texas Constitution.
3131 Sec. 7989A.0103. CONFIRMATION AND DIRECTOR ELECTION
3232 REQUIRED. The temporary directors shall hold an election to
3333 confirm the creation of the district and to elect five permanent
3434 directors as provided by Section 49.102, Water Code.
3535 Sec. 7989A.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3636 temporary directors may not hold an election under Section
3737 7989A.0103 until each municipality in whose corporate limits or
3838 extraterritorial jurisdiction the district is located has
3939 consented by ordinance or resolution to the creation of the
4040 district and to the inclusion of land in the district as required by
4141 applicable law.
4242 Sec. 7989A.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
4343 (a) The district is created to serve a public purpose and benefit.
4444 (b) The district is created to accomplish the purposes of:
4545 (1) a municipal utility district as provided by
4646 general law and Section 59, Article XVI, Texas Constitution; and
4747 (2) Section 52, Article III, Texas Constitution, that
4848 relate to the construction, acquisition, improvement, operation,
4949 or maintenance of macadamized, graveled, or paved roads, or
5050 improvements, including storm drainage, in aid of those roads.
5151 Sec. 7989A.0106. INITIAL DISTRICT TERRITORY. (a) The
5252 district is initially composed of the territory described by
5353 Section 2 of the Act enacting this chapter.
5454 (b) The boundaries and field notes contained in Section 2 of
5555 the Act enacting this chapter form a closure. A mistake made in the
5656 field notes or in copying the field notes in the legislative process
5757 does not affect the district's:
5858 (1) organization, existence, or validity;
5959 (2) right to issue any type of bond for the purposes
6060 for which the district is created or to pay the principal of and
6161 interest on a bond;
6262 (3) right to impose a tax; or
6363 (4) legality or operation.
6464 SUBCHAPTER B. BOARD OF DIRECTORS
6565 Sec. 7989A.0201. GOVERNING BODY; TERMS. (a) The district
6666 is governed by a board of five elected directors.
6767 (b) Except as provided by Section 7989A.0202, directors
6868 serve staggered four-year terms.
6969 Sec. 7989A.0202. TEMPORARY DIRECTORS. (a) The temporary
7070 board consists of:
7171 (1) Carson Vaughn;
7272 (2) Jarrod Tyler Karonika;
7373 (3) Randall Lavender;
7474 (4) Jeffrey Grier; and
7575 (5) Josue Limon.
7676 (b) Temporary directors serve until the earlier of:
7777 (1) the date permanent directors are elected under
7878 Section 7989A.0103; or
7979 (2) the fourth anniversary of the effective date of
8080 the Act enacting this chapter.
8181 (c) If permanent directors have not been elected under
8282 Section 7989A.0103 and the terms of the temporary directors have
8383 expired, successor temporary directors shall be appointed or
8484 reappointed as provided by Subsection (d) to serve terms that
8585 expire on the earlier of:
8686 (1) the date permanent directors are elected under
8787 Section 7989A.0103; or
8888 (2) the fourth anniversary of the date of the
8989 appointment or reappointment.
9090 (d) If Subsection (c) applies, the owner or owners of a
9191 majority of the assessed value of the real property in the district
9292 may submit a petition to the commission requesting that the
9393 commission appoint as successor temporary directors the five
9494 persons named in the petition. The commission shall appoint as
9595 successor temporary directors the five persons named in the
9696 petition.
9797 SUBCHAPTER C. POWERS AND DUTIES
9898 Sec. 7989A.0301. GENERAL POWERS AND DUTIES. The district
9999 has the powers and duties necessary to accomplish the purposes for
100100 which the district is created.
101101 Sec. 7989A.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
102102 DUTIES. The district has the powers and duties provided by the
103103 general law of this state, including Chapters 49 and 54, Water Code,
104104 applicable to municipal utility districts created under Section 59,
105105 Article XVI, Texas Constitution.
106106 Sec. 7989A.0303. AUTHORITY FOR ROAD PROJECTS. Under
107107 Section 52, Article III, Texas Constitution, the district may
108108 design, acquire, construct, finance, issue bonds for, improve,
109109 operate, maintain, and convey to this state, a county, or a
110110 municipality for operation and maintenance macadamized, graveled,
111111 or paved roads, or improvements, including storm drainage, in aid
112112 of those roads.
113113 Sec. 7989A.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
114114 road project must meet all applicable construction standards,
115115 zoning and subdivision requirements, and regulations of each
116116 municipality in whose corporate limits or extraterritorial
117117 jurisdiction the road project is located.
118118 (b) If a road project is not located in the corporate limits
119119 or extraterritorial jurisdiction of a municipality, the road
120120 project must meet all applicable construction standards,
121121 subdivision requirements, and regulations of each county in which
122122 the road project is located.
123123 (c) If the state will maintain and operate the road, the
124124 Texas Transportation Commission must approve the plans and
125125 specifications of the road project.
126126 Sec. 7989A.0305. COMPLIANCE WITH MUNICIPAL CONSENT
127127 ORDINANCE OR RESOLUTION. The district shall comply with all
128128 applicable requirements of any ordinance or resolution that is
129129 adopted under Section 54.016 or 54.0165, Water Code, and that
130130 consents to the creation of the district or to the inclusion of land
131131 in the district.
132132 Sec. 7989A.0306. DIVISION OF DISTRICT. (a) The board, on
133133 its own motion or on receipt of a petition signed by the owner or
134134 owners of a majority of the assessed value of the real property in
135135 the district, may adopt an order dividing the district.
136136 (b) An order dividing a district may create one or more new
137137 districts and may provide for the continuation of the district.
138138 (c) An order dividing the district shall:
139139 (1) name any new district;
140140 (2) include the metes and bounds description of the
141141 territory of each of the districts;
142142 (3) appoint temporary directors for any new district;
143143 and
144144 (4) provide for the division of assets and liabilities
145145 between the districts.
146146 (d) The board may adopt an order dividing the district
147147 before or after the date the board holds an election to confirm the
148148 district's creation.
149149 (e) The district may be divided only if the district:
150150 (1) has never issued any bonds; and
151151 (2) is not imposing ad valorem taxes.
152152 (f) A new district created by the division of the district
153153 may not, at the time the new district is created, contain any land
154154 outside the area described by Section 2 of the Act enacting this
155155 chapter.
156156 (g) On or before the 30th day after the date of adoption of
157157 an order dividing the district, the district shall file the order
158158 with the commission and record the order in the real property
159159 records of each county in which the district is located.
160160 (h) This chapter applies to any new district created by the
161161 division of the district, and a new district has all the powers and
162162 duties of the district.
163163 (i) A new district created by the division of the district
164164 shall hold a confirmation and directors' election.
165165 (j) If the creation of the new district is confirmed, the
166166 new district shall provide the election date and results to the
167167 commission.
168168 (k) A new district created by the division of the district
169169 must hold an election as required by this chapter to obtain voter
170170 approval before the district may impose a maintenance tax or issue
171171 bonds payable wholly or partly from ad valorem taxes.
172172 (l) The district may continue to rely on confirmation,
173173 directors', bond, or tax elections held prior to the division.
174174 (m) Municipal consent to the creation of the district and to
175175 the inclusion of land in the district acts as municipal consent to
176176 the creation of any new district created by the division of the
177177 district and to the inclusion of land in the new district.
178178 Sec. 7989A.0307. STRATEGIC PARTNERSHIP AGREEMENT. The
179179 district may negotiate and enter into a written strategic
180180 partnership agreement under Section 43.0751, Local Government
181181 Code, with a municipality in whose extraterritorial jurisdiction
182182 the district is located.
183183 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
184184 Sec. 7989A.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
185185 The district may issue, without an election, bonds and other
186186 obligations secured by:
187187 (1) revenue other than ad valorem taxes; or
188188 (2) contract payments described by Section
189189 7989A.0403.
190190 (b) The district must hold an election in the manner
191191 provided by Chapters 49 and 54, Water Code, to obtain voter approval
192192 before the district may impose an ad valorem tax or issue bonds
193193 payable from ad valorem taxes.
194194 (c) The district may not issue bonds payable from ad valorem
195195 taxes to finance a road project unless the issuance is approved by a
196196 vote of a two-thirds majority of the district voters voting at an
197197 election held for that purpose.
198198 Sec. 7989A.0402. OPERATION AND MAINTENANCE TAX. (a) If
199199 authorized at an election held under Section 7989A.0401, the
200200 district may impose an operation and maintenance tax on taxable
201201 property in the district in accordance with Section 49.107, Water
202202 Code.
203203 (b) The board shall determine the tax rate. The rate may not
204204 exceed the rate approved at the election.
205205 Sec. 7989A.0403. CONTRACT TAXES. (a) In accordance with
206206 Section 49.108, Water Code, the district may impose a tax other than
207207 an operation and maintenance tax and use the revenue derived from
208208 the tax to make payments under a contract after the provisions of
209209 the contract have been approved by a majority of the district voters
210210 voting at an election held for that purpose.
211211 (b) A contract approved by the district voters may contain a
212212 provision stating that the contract may be modified or amended by
213213 the board without further voter approval.
214214 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
215215 Sec. 7989A.0501. AUTHORITY TO ISSUE BONDS AND OTHER
216216 OBLIGATIONS. The district may issue bonds or other obligations
217217 payable wholly or partly from ad valorem taxes, impact fees,
218218 revenue, contract payments, grants, or other district money, or any
219219 combination of those sources, to pay for any authorized district
220220 purpose.
221221 Sec. 7989A.0502. TAXES FOR BONDS. At the time the district
222222 issues bonds payable wholly or partly from ad valorem taxes, the
223223 board shall provide for the annual imposition of a continuing
224224 direct ad valorem tax, without limit as to rate or amount, while all
225225 or part of the bonds are outstanding as required and in the manner
226226 provided by Sections 54.601 and 54.602, Water Code.
227227 Sec. 7989A.0503. BONDS FOR ROAD PROJECTS. At the time of
228228 issuance, the total principal amount of bonds or other obligations
229229 issued or incurred to finance road projects and payable from ad
230230 valorem taxes may not exceed one-fourth of the assessed value of the
231231 real property in the district.
232232 SECTION 2. The Martindale Municipal Utility District No. 1
233233 of Caldwell County, Texas, initially includes all the territory
234234 contained in the following area:
235235 Being a 297.008 acre tract of land lying in the Stephen B.
236236 Morrison Survey No. 2, Abstract No. 19, Caldwell County, Texas,
237237 said 297.008 acre tract being a portion of a 441 acre tract of land
238238 described in a Deed of Distribution to Herbert Richard Conrads,
239239 dated May 10, 1993, and recorded in Volume 90, Page 891, Official
240240 Public Records of Caldwell County, Texas; said 297.008 acre tract
241241 being more particularly described as follows:
242242 BEGINNING: at a point at the intersection of the northeast
243243 right-of-way line of San Marcos Highway - Highway 80 (varying width
244244 right-of-way) and a southeast line of the aforementioned 441 acre
245245 tract, for the most easterly east corner of a 6.702 acre tract of
246246 land, same being the San Marcos Highway right-of-way, to the State
247247 of Texas as described and recorded in Volume 144, Page 518, Deed
248248 Records of Caldwell County, Texas, the west corner of a 168.42 acre
249249 tract of land as described and recorded in Volume 500, Page 70,
250250 Official Public Records of Caldwell County, Texas, and a south
251251 corner of the herein described 297.008 acre tract, from which a 1/2"
252252 iron rod with plastic cap stamped "CHAPARREL BOUNDARY" found bears
253253 N48°29'05"E, a distance of 0.73 feet;
254254 THENCE: leaving a southeast line of the aforementioned 441
255255 acre tract, along the northeast right-of-way line of the
256256 aforementioned San Marcos Highway and the northeast line of the
257257 aforementioned 6.702 acre tract, the following nine (9) courses and
258258 distances,
259259 N59°29'04"W, a distance of 145.81 feet (Record -
260260 N59°06"W) to a TxDOT Type I concrete monument found for an interior
261261 corner of the herein described 297.008 acre tract,
262262 S29°59'59"W, a distance of 40.00 feet (Record - S30°54"W
263263 ~ 40.00') to a 1/2" iron rod with yellow plastic cap stamped
264264 "CHAPARRAL" found for a south corner of the herein described
265265 297.008 acre tract,
266266 N59°48'32"W, a distance of 499.87 feet (Record - N59°06"W
267267 ~ 500.00) to a 1/2" iron rod with yellow plastic cap stamped
268268 "CHAPARRAL" found for a west corner of the herein described 297.008

667667 SECTION 3. (a) The legal notice of the intention to
668668 introduce this Act, setting forth the general substance of this
669669 Act, has been published as provided by law, and the notice and a
670670 copy of this Act have been furnished to all persons, agencies,
671671 officials, or entities to which they are required to be furnished
672672 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
673673 Government Code.
674674 (b) The governor, one of the required recipients, has
675675 submitted the notice and Act to the Texas Commission on
676676 Environmental Quality.
677677 (c) The Texas Commission on Environmental Quality has filed
678678 its recommendations relating to this Act with the governor, the
679679 lieutenant governor, and the speaker of the house of
680680 representatives within the required time.
681681 (d) All requirements of the constitution and laws of this
682682 state and the rules and procedures of the legislature with respect
683683 to the notice, introduction, and passage of this Act are fulfilled
684684 and accomplished.
685685 SECTION 4. (a) If this Act does not receive a two-thirds
686686 vote of all the members elected to each house, Subchapter C, Chapter
687687 7989A, Special District Local Laws Code, as added by Section 1 of
688688 this Act, is amended by adding Section 7989A.0308 to read as
689689 follows:
690690 Sec. 7989A.0308. NO EMINENT DOMAIN POWER. The district may
691691 not exercise the power of eminent domain.
692692 (b) This section is not intended to be an expression of a
693693 legislative interpretation of the requirements of Section 17(c),
694694 Article I, Texas Constitution.
695695 SECTION 5. This Act takes effect immediately if it receives
696696 a vote of two-thirds of all the members elected to each house, as
697697 provided by Section 39, Article III, Texas Constitution. If this
698698 Act does not receive the vote necessary for immediate effect, this
699699 Act takes effect September 1, 2023.
