5	5	relating to titling and registration of assembled trailers.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Section 501.002, Transportation Code, is amended
8	8	by amending Subdivisions (1), (1-a), (8), (19), and (31) and adding
9	9	Subdivisions (1-b) and (8-a) to read as follows:
10	10	(1) "Assembled trailer" means a trailer, semitrailer,
11	11	or travel trailer that is built or assembled by a hobbyist.
12	12	(1-a) "Assembled vehicle" has the meaning assigned by
13	13	Section 731.001.
14	14	(1-b) [(1-a)] "Certificate of title" means a printed
15	15	record of title issued under Section 501.021.
16	16	(8) "First sale" means:
17	17	(A) the bargain, sale, transfer, or delivery of a
18	18	motor vehicle, other than an assembled trailer or assembled
19	19	vehicle, that has not been previously registered or titled, with
20	20	intent to pass an interest in the motor vehicle, other than a lien,
21	21	regardless of where the bargain, sale, transfer, or delivery
22	22	occurred; and
23	23	(B) the registration or titling of that vehicle.
24	24	(8-a) "Hobbyist" means a person who:
25	25	(A) builds or assembles an assembled trailer for
26	26	personal use;
27	27	(B) does not engage in the continuous sale of
28	28	vehicles, as defined by the department; and
29	29	(C) is not the maker of a kit or a manufacturer,
30	30	as defined by Section 2301.002, Occupations Code.
31	31	(19) "Owner" means:
32	32	(A) a person, other than a manufacturer,
33	33	importer, distributor, or dealer, claiming title to or having a
34	34	right to operate under a lien a motor vehicle that has been subject
35	35	to a first sale; or
36	36	(B) a hobbyist who constructed an assembled
37	37	trailer.
38	38	(31) "Used motor vehicle" means:
39	39	(A) a motor vehicle that has been the subject of a
40	40	first sale; [or]
41	41	(B) an assembled vehicle that has been issued a
42	42	title; or
43	43	(C) an assembled trailer that has been issued a
44	44	title or has been registered under Chapter 502.
45	45	SECTION 2. Subchapter A, Chapter 501, Transportation Code,
46	46	is amended by adding Section 501.009 to read as follows:
47	47	Sec. 501.009. ASSEMBLED TRAILER. For purposes of this
48	48	chapter, an assembled trailer is considered to be, as applicable, a
49	49	trailer, semitrailer, or travel trailer, including a farm trailer
50	50	or farm semitrailer.
51	51	SECTION 3. Section 502.001, Transportation Code, is amended
52	52	by adding Subdivision (2-a) to read as follows:
53	53	(2-a) "Assembled trailer" has the meaning assigned by
54	54	Section 501.002.
55	55	SECTION 4. Subchapter A, Chapter 502, Transportation Code,
56	56	is amended by adding Section 502.006 to read as follows:
57	57	Sec. 502.006. ASSEMBLED TRAILER. For purposes of this
58	58	chapter, an assembled trailer is considered to be, as applicable, a
59	59	trailer, semitrailer, or travel trailer, including a farm trailer
60	60	or farm semitrailer.
61	61	SECTION 5. Section 502.040(a), Transportation Code, is
62	62	amended to read as follows:
63	63	(a) Not more than 30 days after purchasing a vehicle, [or]
64	64	becoming a resident of this state, or completing construction of an
65	65	assembled trailer, the owner of a motor vehicle, trailer, [or]
66	66	semitrailer, or assembled trailer shall apply for the registration
67	67	of the vehicle for:
68	68	(1) each registration year in which the vehicle is
69	69	used or to be used on a public highway; and
70	70	(2) if the vehicle is unregistered for a registration
71	71	year that has begun and that applies to the vehicle and if the
72	72	vehicle is used or to be used on a public highway, the remaining
73	73	portion of that registration year.
74	74	SECTION 6. Section 731.001(a)(4), Transportation Code, is
75	75	amended to read as follows:
76	76	(4) "Assembled vehicle" means:
77	77	(A) an assembled motor vehicle;
78	78	(B) an assembled motorcycle;
79	79	(C) [an assembled trailer;
80	80	[(D)] a custom vehicle;
81	81	(D) [(E)] a street rod;
82	82	(E) [(F)] a replica; or
83	83	(F) [(G)] a glider kit.
84	84	SECTION 7. Section 731.001(a)(3), Transportation Code, is
85	85	repealed.
86	86	SECTION 8. This Act takes effect immediately if it receives
87	87	a vote of two-thirds of all the members elected to each house, as
88	88	provided by Section 39, Article III, Texas Constitution. If this
89	89	Act does not receive the vote necessary for immediate effect, this
90	90	Act takes effect September 1, 2023.
