55 relating to titling and registration of assembled trailers.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 501.002, Transportation Code, is amended
88 by amending Subdivisions (1), (1-a), (8), (19), and (31) and adding
99 Subdivisions (1-b) and (8-a) to read as follows:
1010 (1) "Assembled trailer" means a trailer, semitrailer,
1111 or travel trailer that is built or assembled by a hobbyist.
1212 (1-a) "Assembled vehicle" has the meaning assigned by
1313 Section 731.001.
1414 (1-b) [(1-a)] "Certificate of title" means a printed
1515 record of title issued under Section 501.021.
1616 (8) "First sale" means:
1717 (A) the bargain, sale, transfer, or delivery of a
1818 motor vehicle, other than an assembled trailer or assembled
1919 vehicle, that has not been previously registered or titled, with
2020 intent to pass an interest in the motor vehicle, other than a lien,
2121 regardless of where the bargain, sale, transfer, or delivery
2222 occurred; and
2323 (B) the registration or titling of that vehicle.
2424 (8-a) "Hobbyist" means a person who:
2525 (A) builds or assembles an assembled trailer for
2626 personal use;
2727 (B) does not engage in the continuous sale of
2828 vehicles, as defined by the department; and
2929 (C) is not the maker of a kit or a manufacturer,
3030 as defined by Section 2301.002, Occupations Code.
3131 (19) "Owner" means:
3232 (A) a person, other than a manufacturer,
3333 importer, distributor, or dealer, claiming title to or having a
3434 right to operate under a lien a motor vehicle that has been subject
3535 to a first sale; or
3636 (B) a hobbyist who constructed an assembled
3737 trailer.
3838 (31) "Used motor vehicle" means:
3939 (A) a motor vehicle that has been the subject of a
4040 first sale; [or]
4141 (B) an assembled vehicle that has been issued a
4242 title; or
4343 (C) an assembled trailer that has been issued a
4444 title or has been registered under Chapter 502.
4545 SECTION 2. Subchapter A, Chapter 501, Transportation Code,
4646 is amended by adding Section 501.009 to read as follows:
4747 Sec. 501.009. ASSEMBLED TRAILER. For purposes of this
4848 chapter, an assembled trailer is considered to be, as applicable, a
4949 trailer, semitrailer, or travel trailer, including a farm trailer
5050 or farm semitrailer.
5151 SECTION 3. Section 502.001, Transportation Code, is amended
5252 by adding Subdivision (2-a) to read as follows:
5353 (2-a) "Assembled trailer" has the meaning assigned by
5454 Section 501.002.
5555 SECTION 4. Subchapter A, Chapter 502, Transportation Code,
5656 is amended by adding Section 502.006 to read as follows:
5757 Sec. 502.006. ASSEMBLED TRAILER. For purposes of this
5858 chapter, an assembled trailer is considered to be, as applicable, a
5959 trailer, semitrailer, or travel trailer, including a farm trailer
6060 or farm semitrailer.
6161 SECTION 5. Section 502.040(a), Transportation Code, is
6262 amended to read as follows:
6363 (a) Not more than 30 days after purchasing a vehicle, [or]
6464 becoming a resident of this state, or completing construction of an
6565 assembled trailer, the owner of a motor vehicle, trailer, [or]
6666 semitrailer, or assembled trailer shall apply for the registration
6767 of the vehicle for:
6868 (1) each registration year in which the vehicle is
6969 used or to be used on a public highway; and
7070 (2) if the vehicle is unregistered for a registration
7171 year that has begun and that applies to the vehicle and if the
7272 vehicle is used or to be used on a public highway, the remaining
7373 portion of that registration year.
7474 SECTION 6. Section 731.001(a)(4), Transportation Code, is
7575 amended to read as follows:
7676 (4) "Assembled vehicle" means:
7777 (A) an assembled motor vehicle;
7878 (B) an assembled motorcycle;
7979 (C) [an assembled trailer;
8080 [(D)] a custom vehicle;
8181 (D) [(E)] a street rod;
8282 (E) [(F)] a replica; or
8383 (F) [(G)] a glider kit.
8484 SECTION 7. Section 731.001(a)(3), Transportation Code, is
8585 repealed.
8686 SECTION 8. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2023.
