99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 323, Acts of the 78th Legislature,
1111 Regular Session, 2003, is amended by adding Section 4D to read as

10631063 municipal utility district may select a municipality under Section
10641064 54.0163, Water Code.
10651065 SECTION 6. Section 29, Chapter 323, Acts of the 78th
10661066 Legislature, Regular Session, 2003, is amended by amending
10671067 Subsection (b) and adding Subsection (c) to read as follows:
10681068 (b) Payment for an improvement project, facility, service,
10691069 or equipment agreed to under this section may be made or pledged by
10701070 a local government [municipality] to the district out of any money
10711071 the local government [municipality] collects under Chapter 351, Tax
10721072 Code, or out of any other available money.
10731073 (c) An interlocal agreement of the district may not conflict
10741074 with Chapter 43, Local Government Code.
10751075 SECTION 7. Chapter 323, Acts of the 78th Legislature,
10761076 Regular Session, 2003, is amended by adding Section 29A to read as
10771077 follows:
10781078 Sec. 29A. STRATEGIC PARTNERSHIP AGREEMENTS. (a) The
10791079 district may enter into a strategic partnership agreement as
10801080 provided by Section 43.0751, Local Government Code, with a district
10811081 defined by that section.
10821082 (b) For the purposes of this section, a reference in Section
10831083 43.0751, Local Government Code, to a municipality means the
10841084 district.
10851085 (c) If the district enters into an agreement under this
10861086 section to annex territory for a limited purpose, the district
10871087 shall annex the territory in the manner provided by Section 25 of
10881088 this Act.
10891089 (d) Section 375.282, Local Government Code, does not apply
10901090 to the district.
10911091 SECTION 8. (a) The changes in law made by this Act do not
10921092 affect the entitlement of a member serving on the board of directors
10931093 of the Westwood Magnolia Parkway Improvement District immediately
10941094 before the effective date of this Act to continue to serve for the
10951095 remainder of the member's term.
10961096 (b) The changes in law made by this Act apply only to a
10971097 strategic partnership agreement entered into or renewed by the
10981098 Westwood Magnolia Parkway Improvement District on or after the
10991099 effective date of this Act. A strategic partnership agreement
11001100 entered into or renewed by the Westwood Magnolia Parkway
11011101 Improvement District before the effective date of this Act is
11021102 governed by the law as it existed immediately before the effective
11031103 date of this Act, and that law is continued in effect for that
11041104 purpose.
11051105 SECTION 9. (a) The legal notice of the intention to
11061106 introduce this Act, setting forth the general substance of this
11071107 Act, has been published as provided by law, and the notice and a
11081108 copy of this Act have been furnished to all persons, agencies,
11091109 officials, or entities to which they are required to be furnished
11101110 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
11111111 Government Code.
11121112 (b) The governor, one of the required recipients, has
11131113 submitted the notice and Act to the Texas Commission on
11141114 Environmental Quality.
11151115 (c) The Texas Commission on Environmental Quality has filed
11161116 its recommendations relating to this Act with the governor, the
11171117 lieutenant governor, and the speaker of the house of
11181118 representatives within the required time.
11191119 (d) All requirements of the constitution and laws of this
11201120 state and the rules and procedures of the legislature with respect
11211121 to the notice, introduction, and passage of this Act are fulfilled
11221122 and accomplished.
11231123 SECTION 10. This Act takes effect September 1, 2023.
