55 AN ACT
66 relating to the Mustang Ridge Municipal Utility District, the
77 Wildwood Municipal Utility District, the Creedmoor Municipal
88 Utility District, and the Williamson County Municipal Utility
99 District No. 40; granting limited powers of eminent domain.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 ARTICLE 1. DIVISION OF DISTRICT
1212 SECTION 1.01. Subchapter C, Chapter 7946A, Special District
1313 Local Laws Code, is amended by adding Section 7946A.0307 to read as
1414 follows:
1515 Sec. 7946A.0307. DIVISION OF DISTRICT. (a) The district
1616 may be divided into two or more new districts only if the district:
1717 (1) has no outstanding bonded debt; and
1818 (2) is not imposing ad valorem taxes.
1919 (b) This chapter applies to any new district created by the
2020 division of the district, and a new district has all the powers and
2121 duties of the district.
2222 (c) Any new district created by the division of the district
2323 may not, at the time the new district is created, contain any land
2424 outside the area described by Section 2 of the Act enacting this
2525 chapter.
2626 (d) The board, on its own motion or on receipt of a petition
2727 signed by the owner or owners of a majority of the assessed value of
2828 the real property in the district, may adopt an order dividing the
2929 district.
3030 (e) The board may adopt an order dividing the district
3131 before or after the date the board holds an election under Section
3232 7946A.0103 to confirm the district's creation.
3333 (f) An order dividing the district shall:
3434 (1) name each new district;
3535 (2) include the metes and bounds description of the
3636 territory of each new district;
3737 (3) appoint temporary directors for each new district;
3838 and
3939 (4) provide for the division of assets and liabilities
4040 between or among the new districts.
4141 (g) On or before the 30th day after the date of adoption of
4242 an order dividing the district, the district shall file the order
4343 with the commission and record the order in the real property
4444 records of each county in which the district is located.
4545 (h) Any new district created by the division of the district
4646 shall hold a confirmation and directors' election as required by
4747 Section 7946A.0103. If the voters of a new district do not confirm
4848 the creation of the new district, the assets, obligations,
4949 territory, and governance of the new district revert to the
5050 original district.
5151 (i) If the creation of the new district is confirmed, the
5252 new district shall provide the election date and results to the
5353 commission.
5454 (j) Municipal consent to the creation of the district and to
5555 the inclusion of land in the district granted under Section
5656 7946A.0104 acts as municipal consent to the creation of any new
5757 district created by the division of the district and to the
5858 inclusion of land in the new district.
5959 (k) Any new district created by the division of the district
6060 must hold an election as required by this chapter to obtain voter
6161 approval before the district may impose a maintenance tax or issue
6262 bonds payable wholly or partly from ad valorem taxes.
6363 ARTICLE 2. REPEALER
6464 SECTION 2.01. The following sections of the Special
6565 District Local Laws Code are repealed:
6666 (1) Section 7945A.0306;
6767 (2) Section 7946A.0306;
6868 (3) Section 7951A.0306; and
6969 (4) Section 8141.0307.
7070 ARTICLE 3. TRANSITION AND EFFECTIVE DATE
7171 SECTION 3.01. If this Act does not receive a two-thirds vote
7272 of all the members elected to each house, Article 2 of this Act does
7373 not take effect.
7474 SECTION 3.02. This Act takes effect immediately if it
7575 receives a vote of two-thirds of all the members elected to each
7676 house, as provided by Section 39, Article III, Texas Constitution.
7777 If this Act does not receive the vote necessary for immediate
7878 effect, this Act takes effect September 1, 2023.
