9 | 9 | | District No. 40; granting limited powers of eminent domain. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | ARTICLE 1. DIVISION OF DISTRICT |
---|
12 | 12 | | SECTION 1.01. Subchapter C, Chapter 7946A, Special District |
---|
13 | 13 | | Local Laws Code, is amended by adding Section 7946A.0307 to read as |
---|
14 | 14 | | follows: |
---|
15 | 15 | | Sec. 7946A.0307. DIVISION OF DISTRICT. (a) The district |
---|
16 | 16 | | may be divided into two or more new districts only if the district: |
---|
17 | 17 | | (1) has no outstanding bonded debt; and |
---|
18 | 18 | | (2) is not imposing ad valorem taxes. |
---|
19 | 19 | | (b) This chapter applies to any new district created by the |
---|
20 | 20 | | division of the district, and a new district has all the powers and |
---|
21 | 21 | | duties of the district. |
---|
22 | 22 | | (c) Any new district created by the division of the district |
---|
23 | 23 | | may not, at the time the new district is created, contain any land |
---|
24 | 24 | | outside the area described by Section 2 of the Act enacting this |
---|
25 | 25 | | chapter. |
---|
26 | 26 | | (d) The board, on its own motion or on receipt of a petition |
---|
27 | 27 | | signed by the owner or owners of a majority of the assessed value of |
---|
28 | 28 | | the real property in the district, may adopt an order dividing the |
---|
29 | 29 | | district. |
---|
30 | 30 | | (e) The board may adopt an order dividing the district |
---|
31 | 31 | | before or after the date the board holds an election under Section |
---|
32 | 32 | | 7946A.0103 to confirm the district's creation. |
---|
33 | 33 | | (f) An order dividing the district shall: |
---|
34 | 34 | | (1) name each new district; |
---|
35 | 35 | | (2) include the metes and bounds description of the |
---|
36 | 36 | | territory of each new district; |
---|
37 | 37 | | (3) appoint temporary directors for each new district; |
---|
38 | 38 | | and |
---|
39 | 39 | | (4) provide for the division of assets and liabilities |
---|
40 | 40 | | between or among the new districts. |
---|
41 | 41 | | (g) On or before the 30th day after the date of adoption of |
---|
42 | 42 | | an order dividing the district, the district shall file the order |
---|
43 | 43 | | with the commission and record the order in the real property |
---|
44 | 44 | | records of each county in which the district is located. |
---|
45 | 45 | | (h) Any new district created by the division of the district |
---|
46 | 46 | | shall hold a confirmation and directors' election as required by |
---|
47 | 47 | | Section 7946A.0103. If the voters of a new district do not confirm |
---|
48 | 48 | | the creation of the new district, the assets, obligations, |
---|
49 | 49 | | territory, and governance of the new district revert to the |
---|
50 | 50 | | original district. |
---|
51 | 51 | | (i) If the creation of the new district is confirmed, the |
---|
52 | 52 | | new district shall provide the election date and results to the |
---|
53 | 53 | | commission. |
---|
54 | 54 | | (j) Municipal consent to the creation of the district and to |
---|
55 | 55 | | the inclusion of land in the district granted under Section |
---|
56 | 56 | | 7946A.0104 acts as municipal consent to the creation of any new |
---|
57 | 57 | | district created by the division of the district and to the |
---|
58 | 58 | | inclusion of land in the new district. |
---|
59 | 59 | | (k) Any new district created by the division of the district |
---|
60 | 60 | | must hold an election as required by this chapter to obtain voter |
---|
61 | 61 | | approval before the district may impose a maintenance tax or issue |
---|
62 | 62 | | bonds payable wholly or partly from ad valorem taxes. |
---|
63 | 63 | | ARTICLE 2. REPEALER |
---|
64 | 64 | | SECTION 2.01. The following sections of the Special |
---|
65 | 65 | | District Local Laws Code are repealed: |
---|
66 | 66 | | (1) Section 7945A.0306; |
---|
67 | 67 | | (2) Section 7946A.0306; |
---|
68 | 68 | | (3) Section 7951A.0306; and |
---|
69 | 69 | | (4) Section 8141.0307. |
---|
70 | 70 | | ARTICLE 3. TRANSITION AND EFFECTIVE DATE |
---|
71 | 71 | | SECTION 3.01. If this Act does not receive a two-thirds vote |
---|
72 | 72 | | of all the members elected to each house, Article 2 of this Act does |
---|
73 | 73 | | not take effect. |
---|
74 | 74 | | SECTION 3.02. This Act takes effect immediately if it |
---|
75 | 75 | | receives a vote of two-thirds of all the members elected to each |
---|
76 | 76 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
77 | 77 | | If this Act does not receive the vote necessary for immediate |
---|
78 | 78 | | effect, this Act takes effect September 1, 2023. |
