55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the governor's broadband development
88 council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 490H.002(a), Government Code, is amended
1111 to read as follows:
1212 (a) The council is composed of one nonvoting member
1313 appointed by the broadband development office and the following
1414 voting members appointed by the governor:
1515 (1) two representatives of separate Internet service
1616 provider industry associations, including at least one
1717 representative of an association that primarily represents small
1818 providers, as defined by Section 56.032, Utilities Code;
1919 (2) one representative of the health information
2020 technology industry;
2121 (3) two representatives of unaffiliated nonprofit
2222 organizations that advocate for elderly persons statewide;
2323 (4) two representatives of unaffiliated nonprofit
2424 organizations that have a demonstrated history of working with the
2525 legislature and the public to identify solutions for expanding
2626 broadband to rural, unserved areas of this state;
2727 (5) one representative of an agricultural advocacy
2828 organization in this state;
2929 (6) one representative of a hospital advocacy
3030 organization in this state;
3131 (7) one representative of a medical advocacy
3232 organization in this state;
3333 (8) one county official who serves in an elected
3434 office of a county with a population of less than 35,000;
3535 (8-a) one county clerk of a county with a population of
3636 less than 60,000;
3737 (8-b) one sheriff of a county with a population of less
3838 than 60,000;
3939 (9) one municipal official who serves in an elected
4040 office of a municipality with a population of less than 20,000
4141 located in a county with a population of less than 60,000;
4242 (10) one representative of an institution of higher
4343 education that has its main campus in a county with a population of
4444 less than 60,000;
4545 (11) one representative of a school district with a
4646 territory that includes only counties with a population of less
4747 than 60,000;
4848 (12) one representative from a library association;
4949 (13) one hospital administrator employed by a licensed
5050 hospital located in a county with a population of less than 60,000;
5151 (14) one representative from an electric cooperative
5252 providing broadband;
5353 (15) one representative of a school district with a
5454 territory that includes all or part of a county with a population of
5555 more than 500,000; [and]
5656 (16) one representative of a nonprofit organization
5757 that has a demonstrated history of facilitating broadband adoption
5858 by offering digital literacy training or providing access to
5959 broadband technology; and
6060 (17) one representative from a federally recognized
6161 Indian tribe that is listed on the annual list of Indian tribes
6262 published by the United States secretary of the interior as
6363 required under 25 U.S.C. Section 5131 and that has tribal land in
6464 this state.
6565 SECTION 2. This Act takes effect September 1, 2023.
