66 AN ACT
77 relating to vaccine administration requirements and protection of
88 immunization exemptions for health reasons.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 161, Health and Safety
1111 Code, is amended by adding Sections 161.0035 and 161.0045 to read as
1212 follows:
1313 Sec. 161.0035. VACCINATION ADMINISTRATION REQUIREMENTS.
1414 (a) A person administering a vaccine to a patient shall:
1515 (1) before administering the vaccine, provide to the
1616 patient written information on the vaccine's benefits and risks,
1717 including any vaccine information statement required by the
1818 National Childhood Vaccine Injury Act of 1986 (42 U.S.C. Section
1919 300aa-1 et seq.);
2020 (2) for each vaccine the person administers, maintain
2121 a permanent record of the vaccine manufacturer and lot number;
2222 (3) record each serious health problem, including
2323 hospitalization, injury, or death, a patient sustains following a
2424 vaccine the person administers and place that information in the
2525 patient's record;
2626 (4) report to the federal Vaccine Adverse Event
2727 Reporting System any serious health problem, including
2828 hospitalization, injury, or death, a patient sustains following a
2929 vaccine the person administers; and
3030 (5) for each vaccine administered, provide to the
3131 patient the Vaccine Excipient Summary published by the Centers for
3232 Disease Control and Prevention.
3333 (b) Reporting an adverse event associated with the
3434 administration of a vaccine to the vaccine manufacturer does not
3535 satisfy the requirements of Subsection (a)(4).
3636 (c) A person who violates this section and holds a license
3737 or other certification issued by this state that authorizes the
3838 person to administer a vaccine is subject to disciplinary action by
3939 the appropriate licensing or certifying authority as if the person
4040 violated the applicable licensing or certification law.
4141 (d) A person may bring a civil action to enjoin a violation
4242 of this section against a person who violates this section and who
4343 is not subject to disciplinary action under Subsection (c). A
4444 claimant who prevails in the action may recover attorney's fees and
4545 costs associated with bringing the action.
4646 Sec. 161.0045. IMMUNIZATION HEALTH EXEMPTION PROTECTIONS.
4747 (a) In this section, "health exemption" means an affidavit or
4848 certificate a health care practitioner signs stating that, in the
4949 practitioner's opinion, an immunization poses a significant risk to
5050 the health and well-being of the practitioner's patient.
5151 (b) A governmental official, including an official for a
5252 licensing or certification authority, may not question or sanction
5353 a health care practitioner for granting a health exemption to the
5454 practitioner's patient.
5555 (c) Notwithstanding any other law, a person, including a
5656 state public health official, child-care facility, school,
5757 institution of higher education, public or private employer, and
5858 medical service or long-term care provider, shall:
5959 (1) accept a health exemption:
6060 (A) provided by a health care practitioner; and
6161 (B) filed by an individual on behalf of the
6262 individual or the individual's minor child for education,
6363 employment, medical or long-term care, or another activity
6464 necessary for the individual's quality of life; and
6565 (2) exempt the individual described by the health
6666 exemption from an immunization requirement imposed by the person or
6767 under the laws of this state.
6868 (d) A person who violates Subsection (c) and holds a license
6969 or other certification issued by this state is subject to
7070 disciplinary action by the appropriate licensing or certifying
7171 authority as if the person violated the applicable licensing or
7272 certification law.
7373 (e) A person may bring a civil action to enjoin a violation
7474 of this section against a person who violates this section and who
7575 is not subject to disciplinary action under Subsection (d). A
7676 claimant who prevails in the action may recover attorney's fees and
7777 costs associated with bringing the action.
7878 SECTION 2. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2023.
