66 AN ACT
77 relating to the assessment, destruction, disposal, and release of
88 certain deer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife
1111 Code, is amended by adding Section 43.3635 to read as follows:
1212 Sec. 43.3635. RELEASE OF BREEDER DEER AFTER NEGATIVE TEST
1313 RESULT. Notwithstanding any other provision of this chapter, a
1414 breeder deer for which a negative test result is obtained during an
1515 epidemiological assessment conducted under Section 43.953(a) may
1616 be released onto a release site in accordance with Section 43.361 at
1717 any time on or before the 14th day after the date of the negative
1818 test result.
1919 SECTION 2. Section 43.953(a), Parks and Wildlife Code, is
2020 amended to read as follows:
2121 (a) Before any deer may be destroyed under this subchapter:
2222 (1) an agent of the animal health commission shall
2323 [may] conduct an epidemiological assessment of the deer considered
2424 for destruction and must obtain a positive test result from the deer
2525 using the least intrusive test feasible[:
2626 [(A) if the assessment can be conducted in a
2727 timely manner; and
2828 [(B) contingent on the availability of funding];
2929 and
3030 (2) the department must consider the results of the
3131 [an] assessment[, if] conducted[,] under Subdivision (1).
3232 SECTION 3. Section 43.954(b), Parks and Wildlife Code, is
3333 amended to read as follows:
3434 (b) A notice provided under this section must be sent by
3535 certified mail to the last known address of the permit holder and
3636 must contain:
3737 (1) the date of destruction, which may not be sooner
3838 than the 10th day after the date of the notice;
3939 (2) an explanation of any access restrictions imposed
4040 on the facility or acreage covered by the permit during the
4141 destruction of the deer; and
4242 (3) an explanation of the reasons for the destruction,
4343 including the results of the [any] epidemiological assessment
4444 conducted under Section 43.953(a) applicable to the deer that are
4545 the subject of the notice.
4646 SECTION 4. Section 43.955, Parks and Wildlife Code, is
4747 amended to read as follows:
4848 Sec. 43.955. COST OF ASSESSMENT AND DESTRUCTION OF DEER
4949 [RECOVERY]. The department [applicable permit holder] shall pay
5050 all costs associated with:
5151 (1) the [an] epidemiological assessment conducted
5252 under Section 43.953(a) [this subchapter] to the animal health
5353 commission; and
5454 (2) the destruction of deer under this subchapter,
5555 including any costs associated with the disposal of the deer [to the
5656 department].
5757 SECTION 5. As soon as practicable after the effective date
5858 of this Act, the Parks and Wildlife Commission shall adopt or amend
5959 rules as necessary to comply with the changes in law made by this
6060 Act.
6161 SECTION 6. The change in law made by this Act to Section
6262 43.955, Parks and Wildlife Code, applies only to the payment of
6363 costs arising from an epidemiological assessment conducted, or the
6464 destruction of deer commenced, on or after the effective date of
6565 this Act.
6666 SECTION 7. This Act takes effect immediately if it receives
6767 a vote of two-thirds of all the members elected to each house, as
6868 provided by Section 39, Article III, Texas Constitution. If this
6969 Act does not receive the vote necessary for immediate effect, this
7070 Act takes effect September 1, 2023.
