88 identification to file certain documents with the county clerk.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 191.010, Local Government
1111 Code, is amended to read as follows:
1212 Sec. 191.010. AUTHORITY TO REQUIRE PHOTO IDENTIFICATION TO
1313 FILE CERTAIN DOCUMENTS [IN CERTAIN COUNTIES].
1414 SECTION 2. Section 191.010(b), Local Government Code, is
1515 amended to read as follows:
1616 (b) A county clerk [in a county with a population of 800,000
1717 or more] may require a person presenting a document in person for
1818 filing in the real property records of the county to present a photo
1919 identification to the clerk. The clerk may copy the photo
2020 identification or record information from the photo
2121 identification. The clerk may not charge a person a fee to copy or
2222 record the information from a photo identification.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
