44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prohibiting certain transfers, purchases, and
77 possession of assault weapons; creating criminal offenses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 46, Penal Code, is amended by adding
1010 Section 46.055 to read as follows:
1111 Sec. 46.055. UNLAWFUL PURCHASE OR POSSESSION OF ASSAULT
1212 WEAPON. (a) In this section, "assault weapon" means:
1313 (1) a semiautomatic centerfire rifle that has the
1414 capacity to accept a detachable magazine and has:
1515 (A) a pistol grip that protrudes conspicuously
1616 beneath the action of the firearm;
1717 (B) a folding or telescoping stock;
1818 (C) a thumbhole stock;
1919 (D) a second handgrip or a protruding grip that
2020 can be held by the non-trigger hand;
2121 (E) a flash suppressor; or
2222 (F) a grenade launcher or flare launcher;
2323 (2) a semiautomatic centerfire rifle that has a fixed
2424 magazine that holds more than 10 rounds of ammunition;
2525 (3) a semiautomatic centerfire rifle that has an
2626 overall length of less than 30 inches;
2727 (4) a semiautomatic shotgun that has the capacity to
2828 accept a detachable magazine;
2929 (5) a semiautomatic shotgun that has a folding or
3030 telescoping stock and has:
3131 (A) a thumbhole stock; or
3232 (B) a second handgrip or a protruding grip that
3333 can be held by the non-trigger hand;
3434 (6) a semiautomatic pistol that has the capacity to
3535 accept a detachable magazine and has:
3636 (A) a second handgrip or a protruding grip that
3737 can be held by the non-trigger hand;
3838 (B) an ammunition magazine that attaches to the
3939 pistol outside of the pistol grip;
4040 (C) a threaded barrel capable of accepting a
4141 flash suppressor, forward handgrip, or silencer; or
4242 (D) a shroud that is attached to or partially or
4343 completely encircles the barrel and that permits the shooter to
4444 hold the firearm with the non-trigger hand without being burned;
4545 (7) a semiautomatic pistol that has a fixed magazine
4646 that holds more than 10 rounds of ammunition;
4747 (8) a revolving cylinder shotgun; or
4848 (9) a conversion kit, part, or combination of parts
4949 from which an assault weapon can be assembled or with which a
5050 firearm may be converted into a weapon described by Subdivision
5151 (1), (2), (3), (4), (5), (6), (7), or (8).
5252 (b) A person who is younger than 21 years of age commits an
5353 offense if the person knowingly:
5454 (1) purchases an assault weapon; or
5555 (2) possesses an assault weapon.
5656 (c) An offense under this section is a Class A misdemeanor.
5757 (d) It is a defense to prosecution under Subsection (b)(1)
5858 that the actor purchased the assault weapon for the actual
5959 discharge of official duties as:
6060 (1) a peace officer; or
6161 (2) a member of the armed forces or state military
6262 forces as defined by Section 431.001, Government Code.
6363 (e) It is a defense to prosecution under Subsection (b)(2)
6464 that:
6565 (1) the actor possessed the assault weapon in the
6666 actual discharge of official duties, or directly en route to or from
6767 the person's place of assignment, as:
6868 (A) a peace officer; or
6969 (B) a member of the armed forces or state
7070 military forces as defined by Section 431.001, Government Code; or
7171 (2) the actor lawfully possessed the assault weapon on
7272 August 31, 2023.
7373 SECTION 2. Section 46.06, Penal Code, is amended by
7474 amending Subsections (a), (c), and (d) and adding Subsection (c-1)
7575 to read as follows:
7676 (a) A person commits an offense if the person:
7777 (1) sells, rents, leases, loans, or gives a handgun to
7878 any person knowing that the person to whom the handgun is to be
7979 delivered intends to use it unlawfully or in the commission of an
8080 unlawful act;
8181 (2) intentionally or knowingly sells, rents, leases,
8282 or gives or offers to sell, rent, lease, or give:
8383 (A) a [to any child younger than 18 years of age
8484 any firearm,] club, [or] location-restricted knife, or firearm
8585 other than an assault weapon to a person younger than 18 years of
8686 age; or
8787 (B) an assault weapon to a person younger than 21
8888 years of age;
8989 (3) intentionally, knowingly, or recklessly sells a
9090 firearm or ammunition for a firearm to any person who is
9191 intoxicated;
9292 (4) knowingly sells a firearm or ammunition for a
9393 firearm to any person who has been convicted of a felony before the
9494 fifth anniversary of the later of the following dates:
9595 (A) the person's release from confinement
9696 following conviction of the felony; or
9797 (B) the person's release from supervision under
9898 community supervision, parole, or mandatory supervision following
9999 conviction of the felony;
100100 (5) sells, rents, leases, loans, or gives a handgun to
101101 any person knowing that an active protective order is directed to
102102 the person to whom the handgun is to be delivered;
103103 (6) knowingly purchases, rents, leases, or receives as
104104 a loan or gift from another a handgun while an active protective
105105 order is directed to the actor; or
106106 (7) while prohibited from possessing a firearm under
107107 state or federal law, knowingly makes a material false statement on
108108 a form that is:
109109 (A) required by state or federal law for the
110110 purchase, sale, or other transfer of a firearm; and
111111 (B) submitted to a [licensed] firearms dealer
112112 licensed under [, as defined by] 18 U.S.C. Section 923.
113113 (c) It is an affirmative defense to prosecution under
114114 Subsection (a)(2)(A) [(a)(2)] that the transfer was to a minor
115115 whose parent or the person having legal custody of the minor had
116116 given written permission for the sale or, if the transfer was other
117117 than a sale, the parent or person having legal custody had given
118118 effective consent.
119119 (c-1) It is a defense to prosecution under Subsection
120120 (a)(2)(B) that the transfer was to a person who provided evidence to
121121 the actor that the person is:
122122 (1) a peace officer; or
123123 (2) a member of the armed forces or state military
124124 forces as defined by Section 431.001, Government Code.
125125 (d) An offense under this section is a Class A misdemeanor,
126126 except that:
127127 (1) an offense under Subsection (a)(2)(A) [(a)(2)] is
128128 a state jail felony if the weapon that is the subject of the offense
129129 is a handgun; [and]
130130 (2) an offense under Subsection (a)(2)(B) is a state
131131 jail felony; and
132132 (3) an offense under Subsection (a)(7) is a state jail
133133 felony.
134134 SECTION 3. Section 46.06(b), Penal Code, is amended by
135135 adding Subdivision (3) to read as follows:
136136 (3) "Assault weapon" has the meaning assigned by
137137 Section 46.055.
138138 SECTION 4. The change in law made by this Act applies only
139139 to an offense committed on or after the effective date of this Act.
140140 An offense committed before the effective date of this Act is
141141 governed by the law in effect on the date the offense was committed,
142142 and the former law is continued in effect for that purpose. For
143143 purposes of this section, an offense was committed before the
144144 effective date of this Act if any element of the offense occurred
145145 before that date.
146146 SECTION 5. This Act takes effect September 1, 2023.
