| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter C, Chapter 341, Health and Safety |
|---|
| 9 | 9 | | Code, is amended by adding Section 341.043 to read as follows: |

| 10 | 10 | | Sec. 341.043. BOIL WATER NOTICE ALERT SYSTEM. (a) The |
|---|
| 11 | 11 | | commission shall develop and implement an alert system to be |
|---|
| 12 | 12 | | activated in the event of a boil water notice and any related |
|---|
| 13 | 13 | | information, including any recission or expiration of the boil |
|---|
| 14 | 14 | | water notice. |
|---|
| 15 | 15 | | (b) The alert system must include the ability to provide |
|---|
| 16 | 16 | | notifications through electronic instant messaging. |
|---|
| 17 | 17 | | (c) The commission may adopt rules and procedures necessary |
|---|
| 18 | 18 | | to implement this section. |
|---|
| 19 | 19 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 20 | 20 | | of this Act, the Texas Commission on Environmental Quality shall |
|---|
| 21 | 21 | | establish the alert system required by Section 341.043, Health and |
|---|
| 22 | 22 | | Safety Code, as added by this Act. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
