55 AN ACT
66 relating to requiring public institutions of higher education to
77 make available to students certain pregnancy-related informational
88 materials published by the Department of State Health Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1111 amended by adding Section 51.9196 to read as follows:
1212 Sec. 51.9196. REQUIRED INFORMATION FOR STUDENTS RELATED TO
1313 PREGNANCY RESOURCES. (a) In this section:
1414 (1) "Institution of higher education" has the meaning
1515 assigned by Section 61.003.
1616 (2) "QR code" has the meaning assigned by Section
1717 443.001, Health and Safety Code.
1818 (b) The student health center of each institution of higher
1919 education shall:
2020 (1) make available at no cost to students the
2121 informational materials described by Section 171.014, Health and
2222 Safety Code, in a printed format; and
2323 (2) post in a conspicuous location at the student
2424 health center a sign containing a QR code that may be scanned and
2525 that leads to the Internet website described by Section 171.014(e),
2626 Health and Safety Code.
2727 (c) The executive commissioner of the Health and Human
2828 Services Commission by rule shall prescribe the design and content
2929 of the sign required to be posted under this section.
3030 SECTION 2. Not later than January 15, 2024, the executive
3131 commissioner of the Health and Human Services Commission shall
3232 adopt rules as required by Section 51.9196(c), Education Code, as
3333 added by this Act.
3434 SECTION 3. This Act applies beginning with the 2024 spring
3535 semester.
3636 SECTION 4. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2023.
