| 7 | 7 | | make available to students certain pregnancy-related informational |
|---|
| 8 | 8 | | materials published by the Department of State Health Services. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 51.9196 to read as follows: |
|---|
| 12 | 12 | | Sec. 51.9196. REQUIRED INFORMATION FOR STUDENTS RELATED TO |
|---|
| 13 | 13 | | PREGNANCY RESOURCES. (a) In this section: |
|---|
| 14 | 14 | | (1) "Institution of higher education" has the meaning |
|---|
| 15 | 15 | | assigned by Section 61.003. |
|---|
| 16 | 16 | | (2) "QR code" has the meaning assigned by Section |
|---|
| 17 | 17 | | 443.001, Health and Safety Code. |
|---|
| 18 | 18 | | (b) The student health center of each institution of higher |
|---|
| 19 | 19 | | education shall: |
|---|
| 20 | 20 | | (1) make available at no cost to students the |
|---|
| 21 | 21 | | informational materials described by Section 171.014, Health and |
|---|
| 22 | 22 | | Safety Code, in a printed format; and |
|---|
| 23 | 23 | | (2) post in a conspicuous location at the student |
|---|
| 24 | 24 | | health center a sign containing a QR code that may be scanned and |
|---|
| 25 | 25 | | that leads to the Internet website described by Section 171.014(e), |
|---|
| 26 | 26 | | Health and Safety Code. |
|---|
| 27 | 27 | | (c) The executive commissioner of the Health and Human |
|---|
| 28 | 28 | | Services Commission by rule shall prescribe the design and content |
|---|
| 29 | 29 | | of the sign required to be posted under this section. |
|---|
| 30 | 30 | | SECTION 2. Not later than January 15, 2024, the executive |
|---|
| 31 | 31 | | commissioner of the Health and Human Services Commission shall |
|---|
| 32 | 32 | | adopt rules as required by Section 51.9196(c), Education Code, as |
|---|
| 33 | 33 | | added by this Act. |
|---|
| 34 | 34 | | SECTION 3. This Act applies beginning with the 2024 spring |
|---|
| 35 | 35 | | semester. |
|---|
| 36 | 36 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2023. |
