| 7 | 7 | | relating to a parent's right to access certain records regarding |

| 8 | 8 | | school library materials obtained by the parent's child and the |
|---|
| 9 | 9 | | option to receive notice each time the parent's child obtains a |
|---|
| 10 | 10 | | school library material. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 26.004(b), Education Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (b) A parent is entitled to access to all written records of |
|---|
| 15 | 15 | | a school district concerning the parent's child, including: |
|---|
| 16 | 16 | | (1) attendance records; |
|---|
| 17 | 17 | | (2) test scores; |
|---|
| 18 | 18 | | (3) grades; |
|---|
| 19 | 19 | | (4) disciplinary records; |
|---|
| 20 | 20 | | (5) counseling records; |
|---|
| 21 | 21 | | (6) psychological records; |
|---|
| 22 | 22 | | (7) applications for admission; |
|---|
| 23 | 23 | | (8) health and immunization information; |
|---|
| 24 | 24 | | (9) teacher and school counselor evaluations; |
|---|
| 25 | 25 | | (10) reports of behavioral patterns; [and] |
|---|
| 26 | 26 | | (11) records relating to assistance provided for |
|---|
| 27 | 27 | | learning difficulties, including information collected regarding |
|---|
| 28 | 28 | | any intervention strategies used with the child; and |
|---|
| 29 | 29 | | (12) records relating to school library materials the |
|---|
| 30 | 30 | | child obtains from a school library. |
|---|
| 31 | 31 | | SECTION 2. Chapter 26, Education Code, is amended by adding |
|---|
| 32 | 32 | | Section 26.017 to read as follows: |
|---|
| 33 | 33 | | Sec. 26.017. NOTICE REGARDING SCHOOL LIBRARY MATERIALS. |
|---|
| 34 | 34 | | (a) Before each school year, a school district shall provide |
|---|
| 35 | 35 | | written notice to a parent of each child enrolled in the district |
|---|
| 36 | 36 | | regarding the option to receive notice each time the child obtains a |
|---|
| 37 | 37 | | school library material from a school library in the district. |
|---|
| 38 | 38 | | (b) For each parent who elects to receive notice under |
|---|
| 39 | 39 | | Subsection (a), the school district shall notify the parent by |
|---|
| 40 | 40 | | e-mail each time the parent's child obtains a school library |
|---|
| 41 | 41 | | material from a school library in the district. The notice must |
|---|
| 42 | 42 | | include, as applicable, the title, author, genre, and return date |
|---|
| 43 | 43 | | of the school library material. |
|---|
| 44 | 44 | | SECTION 3. This Act applies beginning with the 2023-2024 |
|---|
| 45 | 45 | | school year. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2023. |
